Is Touching Someone's MAGA Hat Assault? Yes / No

High schooler faces potential criminal charge after video of him knocking MAGA hat off fellow student goes viral

A high school student from Edmond, Okla., could face a potential criminal charge after a viral video showed him knocking a “Make America Great Again” hat off of a peer’s head and grabbing his “Trump 2020” flag.

School officials at Edmond Santa Fe High School told KOCO 5 that they have both surveillance video and cellphone video depicting the incident. Due to student confidentiality, the school will not release the surveillance video.

Assault or kids will be kids?
The solution for this incident is obvious.
Criminal assault charges need to be filed against the larger student.
How old is the attacker? He appears too old for Public School.

not sure, but grabbing a psy without consent is... did the MAGA leader learn that yet?

maybe not a crime, but it could be considered bullying and the student be expelled because of it - that said, maybe the school should ban such hats as they are disrupting the schools learning environment

the black person looks violent based on his actions... imo might want to seek help controlling his feelings

It is "assault" but Einstein's General Theory of Relativity applies to the meaning of words....... and it is not assault on the same scale as if he had broken the nose of the person wearing the hat.

What you describe is assault with bodily injury - yes?
Assault may occur without bodily injury - True?

It is possible for a schoolmate to grab somebody's hat and it really was not assault and both kids could just look at the incident as just clowning around....... but in 2019 it is actually dangerous for many kids to admit that they like President Trump or at least some of his ideas.

I see what you mean.... it was definitely and clearly assault..... and if the incident had taken place on the street somewhere the kid with the hat could well have ended up bleeding!!!!!

assault maybe, intimidation definitely.. and considering the circumstance, I'd go ahead and charge assault. Their is getting to be a lot of these cases.. gun pulled on one couple, 81 year old man assaulted in a grocery store.. the LEFT and their MSM buddies have certainly ginned this up.... which of mouths of the Left have equated the Make America Great Again cap with a Klan hood? If that is not nutty enough.. I read recently that some college professor was wanting to eliminate the American Flag altogether. The Left hates America and they always have. Just like the European peerage always has, "free people governing themselves! "

In this case, I would call it battery, as it was not a gentle removal of the hat. (In FL, assault is a threat, battery is an action).

By the definitions currently available, touching someone's person, clothing, accessories or personal belongings without their express permission, in writing and notarized, is assault.

That said, if you aren't a relative picking lint off my shoulder, life is going to get interesting for you.... ;)

    Yet
@ToddWB isn't convinced it is assault.

I see no maybe about assault.
And glad I didn't introduce the idea of "battery".

    Please watch the video.

    Was it assault or not.
Is touching anyone's MAGA cap assault?

Yes it's assault. They should follow the school policy - either it's internal discipline or getting the cops in.

    I would say both.

To the extent school rules were violated, the school should discipline.
To the extent laws were violated, the police should be involved.

Our society needs to take more aggressive action on those who
    commit such assault behaviors.
Without the certainty of an appropriate, civil action against the perp,
    people will become more licentious.
Witness all the falsehoods among the @MeToo never brought up on charges.
    Civil or criminal.

In this case I would like to see the MAGA cap kid's parents bring the parent/guardian
of the attacker to civil court. That way, parents are put on notice too!

Using Republican's own words : "what a bunch of snowflakes"

Anyone involved in school settings knows that no principal is going to call the police to arrest a kid for rough-housing/ intimidation. A teacher would have confronted the aggressor w/ a warning and then send the students back to class. That's how it was done when I was in high school many decades back. Republicans come across as such pansies sometimes.

Trump-wear/ fatigues/ caps are viewed as provocative/ disruptive and not allowed in California schools/ some restaurants.

Previously I posted this video to illustrate the danger/ possible harm one accepts if wearing MAGA caps. But also to take note that if anti-Trump Americans cross the line and commit assault they should be arrested ASAP. The kid was protected by a bunch of Afro/ Latino bros. On the other hand, a college Republican given a black eye by a thuggish student in Berkeley can never be tolerated; hope police find the aggressor. In interviews, the Young Republican student indicated that the usual harassment consists of table/ posters being knocked over/ messed with.

That's a clear no for me. There was no bodily harm nor attempt to cause any, so it's not assault.

It's clearly a form of bullying, that guy is scum, he completely deserves to be the "face of hate" all over the Internet, but it's not a crime.

If he gets detention from his school, great. But no criminal charges. Leave that kind of "harassment is a crime" BS to the feminists and similar totalitarians.

Most jurisdictions would consider the act of aggressively flipping off someone's hat (in that manner) to be a "battery".

It's assault in this case because he was clearly being intimidated, got his hat removed twice and the guy tried to steal his Trump flag/banner.

    The kid should be arrested.
