President Trump’s campaign organization Tuesday filed charges against friend-turned-enemy Omarosa Manigault Newman, claiming that she broke a 2016 nondisclosure contract by disparaging the president in her new book and revealing private talks from the ultra-secret White House Situation Room.

In New York, Trump campaign lawyers filed for an arbitration to force the former “Apprentice” star to abide by the agreement they say she signed when joining the 2016 campaign.

According to a sample of the agreement provided to Secrets, she was required to keep proprietary information about the president, his companies or his family confidential and to never “disparage” the Trump family “during the term of your service and at all times thereafter.”

A half-century ago, in Pickering v. Board of Education, the Supreme Court made clear that government employees may not “constitutionally be compelled to relinquish the First Amendment rights they would otherwise enjoy as citizens to comment on matters of public interest in connection with” the government office where they work. Pickering involved a public school teacher who was fired after sending a letter to the local paper criticizing the local board of education’s fiscal policies. As the Court explained, permitting government employers to retaliate against such employees would damage our democracy.

Their may be reasons the NDA will not hold up. This is not one of them. I signed a number of documents saying I would not disclose classified information after I left the Air Force. The First Amendment would not protect me.

She signed an agreement. No one forced her to sign it. The only issue is how tight it is.

I approve of this "nondisclosure agreement" nonsense being made a legal issue since it is now, technically, the President of the United States we're talking about. I don't like Trump's personal policy of buying people's silence insofar as "disparaging" his majesty is concerned being applied to the West Wing or any other part of government. It's also good for Trump's practice of using these ridiculous agreements to be thoroughly exposed and discussed in general, because the entire idea is absurd.

 

Just further highlights the crappy personel Trump hires. Seems the only thing Trump is interested from people who work for him in the White House are kiss-asses.
