Now, Noem is taking the Biden administration to task, and demands that the permit be approved.

"Mount Rushmore is the very best place to celebrate America’s birthday and all that makes our country special," Noem wrote in a lawsuit, Fox News reported. "After telling us they’d ‘circle back,’ the Biden Administration has not responded to our request to uphold the Memorandum Agreement between the State of South Dakota and the National Parks Service to host a safe and responsible national celebration and fireworks show."

She added that the decision abandons “long standing precedent.”

I’m glad that Gov. Noem is taking the regime to court for reneging on an arrangement between the feds and the state. Fireworks on the 4th of July there are a beautiful sight and very patriotic. The covid concerns are baseless as this is an outdoor event and by then large majorities will have either the vaccine natural immunity.

The Biden regime is being pathetically spiteful and vindictive. He’s punishing the state for it being Trump who allowed the fireworks to resume there. And he’s being vindictive against the state and it’s governor for never locking down or mandating masks.

The National Park Service rejected the state's application due to safety concerns and objections from local Native American tribes. Noem's suit claims that the decision was "arbitrary and capricious" and violated the powers granted to the agency in the Constitution.

The request was turned down because of concerns about the spread of COVID-19, the high risk of sparking dangerous wildfires in the dry area in the middle of summer and because of opposition by local Native American tribes, according to a letter from NPS Regional Director Herbert Frost that was obtained by The Hill.
Potential risks to the park itself, and to the health and safety of employees and visitors associated with the fireworks demonstration continue to be a concern and are still being evaluated as a result of the 2020 event,” Frost wrote to the head of the state’s tourism
department, referring to then-President Donald Trump’s insistence on fireworks at the spot for the first time in 11 years last Independence Day.

“In addition, the park’s many tribal partners expressly oppose fireworks at the Memorial,” Frost added.

These factors, compiled with the COVID-19 pandemic, do not allow a safe and responsible fireworks display to be held at this site,” he wrote.

In other words it wasn’t Biden who canceled the fireworks.

It was his regime that did. They revoked an existing agreement made with the state. Covid as an excuse is pure bs. It’s an outdoor event. Fireworks were a regular thing there on the 4th of July until obama was President. Trump brought them back. As to fire danger, that can be determined each year based on conditions. It is sad that we can only have fireworks at a national park honoring our Presidents only in years a Republican is President now.

Vladimir Biden went too far. Biden has to lose this case. He has no basis in law to do it.

    Biden is not the president?

He does not control the parks service??????

    Come again?

Tribes are not residents of that park. Tribes are not our rulers.

In fact they are operating as nations.

So Biden appointed Frost??? Stop the regime nonsense. National parks denied the request. You look desperate trying to claim Biden is responsible.

    https://www.usnews.com/news/best-st...shmore-fireworks-cost-south-dakota-15-million

South Dakota states the state made over 22 million dollars holding that event. Fireworks cost $350,000.

It would seems so. They allowed the fireworks last year. There was no known covid spread from that outdoor event and there’s less danger from it this year. Biden is responsible. He ignored the governors appeal to override his appointee.

So you have no proof. Got it.

Frost made the call. Especially after the mess that was left to clean up plus the risk of fires.

You do not know the directors name.
Shawn Benge (acting) January 20, 2021[15]
Who took office that day? Besides Benge? Biden put him in charge.

    So you have no proof.
A man named Benge was installed on Jan 20, this year. Who was president on the 20th?

I know you want to excuse Biden but he was sworn as president.

“Noem, who had filed suit against the federal government, called the decision “partisan and political.”

“Well, from them, they told me they would circle back,” she said. “But they have denied giving us our permits that we need to host this event. And, for me, I’m incredibly disappointed because it wasn’t based on anything significant. We had met all the environmental checklists. We had the go/no-go checklist prepared and agreed to. We had consulted with our tribes. It appears to be a very partisan and political denial of our right to host this fireworks event.””

There has never been a fireworks fire claimed by South Dakota.
What mess? South Dakota funded it last year.

The letter denying the request came from Frost, who is a director.

Doesn’t mean there isn’t potential for a fire. You do realize fireworks have caused fires before, right? This shouldn’t be news to you

South Dakota has a mitigation system to prevent fires from burning down the park.

Last year the company doing the fireworks came from CA and were paid $350,000 totally paid by South Dakota. Biden has no dog in this hunt.

When was Mt Rushmore blazing due to fireworks?

Who is the National Park Service director?
    National Park Service
    Agency overview
    Annual budget $4.085 billion (2019)
Agency executive Shawn Benge, Exercising the Delegated Authority of the Director
Parent agency Department of the Interior
    Website www.NPS.gov

Surely since you think Biden lost his job as president, you know the correct answer this time?
