    First-degree murder charge for driver accused of plowing into Charlottesville crowd, killing Heather Heyer

    CHARLOTTESVILLE, Va. —A judge here concluded Thursday that there is enough evidence to pursue a first-degree murder charge against the self-professed neo-Nazi accused of plowing his car into a crowd in August, killing one woman.

    James Alex Fields Jr., 20, has been jailed in Charlottesville since his arrest during a rally of white supremacists on Aug. 12. Authorities say he rammed his car into another vehicle on purpose on a crowded street, killing counterprotester Heather D. Heyer 32, and injuring 35 other people.

    The incident — captured on video and seen worldwide — occurred amid clashes involving hundreds of white supremacists and counterprotesters at a gathering billed by organizers as a “Unite the Right” rally, in the home town of the University of Virginia.

    Why are you being apparently insulting by calling the dead woman a socialist? Does that make you feel superior to the dead woman ? Is that your way of supporting the Nazi murderer?

    "On the witness stand, police detective Steven Young said investigators determined that Fields had traveled to Charlottesville alone from his home in Maumee, Ohio. Under questioning by defense lawyer Denise Lunsford, Young said investigators found no evidence that Fields was affiliated with any of the white supremacist groups that took part in the demonstration."

    So still no motive...

    Not if you think Fields should face the death penalty.

    Personally, I think he should be facing a capital murder charge, but it's extremely difficult to bring that charge here in Virginia.

    I will have to accept that the prosecutor had a good case since he is going after murder one. It would be sad if that little Nazi bastard gets away with a punishment that us less than the crime he committed deserves.

    I watch enough LA Law, Perry Mason, The D A, Blue Bloods, Chicago PD and Hawaii 5 O 1.0 and 1.2 to say he committed murder and just sharpen the guilitine already.

    Seems like an over charge again as even the police said ( and i quoted) no motive... How do you have premeditation without motive?

    WHY??? As I noted weeks ago this thing went silent. Nothing about any motive they found, any statements he made, any evidence they found. What is the evidence of premeditation?

    Saying that he isn't affiliated with a specific group is not the same as saying he wasn't a white supremacist. People who knew him have already spoken out about that, and he was rubbing elbows with self-described fascists at the event.

    I have no reason to doubt Detective Young's assessment that Fields was not officially or formally affiliated with any of the white supremacist groups that participated in the protests, but he was pictured demonstrating with one of them (Vanguard America) in C'ville on August 12:

    Keep in mind the charge against him now and burden of proof needed..This guy might walk due to overcharging.

    From what I heard, the evidence was him backing up the car before he proceeded forward to drive into the crowd. Evidently, that decision was what qualified as premeditation.

    Backing up in an attempt to leave or an attempt to gain speed to kill people... They would have been better off with 2nd degree.

    Defense is going to use the protest/violence around him as an out.

    Fields would have been charged with capital murder if a terrorism charge had been made in relation to his attack. Personally, I don't see how driving into a public demonstration and killing and injuring people doesn't qualify as terrorism.

    The authorities have screwed the pooch on this from the get-go. Had Mayor Singer and Governor McAuliffe done their jobs Heather Heyer would be alive today and we wouldn't be having this discussion. It makes me sick that those two are going to escape their dereliction of duty with impunity.

    Not a lawyer here, but their local laws might not cover it. There's always a chance the Feds will step in after the State has it's case.
