Professor who bashed Barbara Bush won’t be disciplined by university

    You are correct; only Congress shall not restrict free speech; to me its apparent the school finds the statements made by this woman to be acceptable under their policy (if one actually exists); however if they chose to impose consequences such as suspension or termination of employment or even present her with a medal, that would likewise be their within their rights.

    And remember, in other posts here over the years, I've maintained that while you will not go to jail for expressing your opinion under the first amendment, there could be other consequences. I still believe that holds true.

    Bingo. CSU's are not allowed to terminate their employees because of their political views. Their regulations and policies won't allow them to do so.

    I think it does matter. Fresno State is a state institution and is bound by the first amendment. I think it would be illegal for them to fire her for what she said. They would have to come up with some valid reason beyond the unconstitutional. That isn't easy given the rules of tenure. The best bet is just to consider her rude and ignore her.

    She may still have her job, but I suspect her tenure there will be a thorn in her side from here on out. Like someone said above, free speech does not mean free from consequences.

    I really don't know what the finer points of the law are regarding Fresno State and the rules governing the conduct of its employees but its president said she was an "embarrassment to the university". Do you know if she used a school or a personal Twitter account when she made her comment?

    It was her personal Twitter account on her own time. That was the main reason the university cited for not disciplining her. However, she did taunt her employer in at least one tweet. The university didn't really say either way if that was considered in their decision.

    It looks like the president of FSU did about all he could do, which was denounce her remarks.

    Maybe or maybe not. It's hard to say. It looks like a quick google search suggests that disciplinary action including termination isn't exactly a rare event for situations such as these. Obviously the fact that her employer is public means the rules for engagement are different than for those of us that work in the private sector.
