Honest and short answer: The US Constitution. Gay marriage is protected by the US constitution. Gay citizens are protected by the Equal Protection clause and thus entitled to the same rights and privileges afforded heterosexual individuals. The States and local municipalities are also protected by the US Constitution. They are protected, by the 10th amendment, from being required to enforce federal laws.
