    Alas, we have a victory for religious freedom in the COVID lockdown era. The Supreme Court recently ruled that New York Gov. Andrew Cuomo illegally targeted churches in his COVID lockdown order—and Justice Amy Coney Barrett was the deciding vote. In the 5-4 decision, the Court ruled Cuomo’s edict violated First Amendment rights (via NYT):

    The Supreme Court late Wednesday night barred restrictions on religious services in New York that Gov. Andrew M. Cuomo had imposed to combat the coronavirus.

    The vote was 5 to 4, with Chief Justice John G. Roberts Jr. and the court’s three liberal members in dissent. The order was the first in which the court’s newest member, Justice Amy Coney Barrett, played a decisive role.

    In an unsigned opinion, the majority said Mr. Cuomo’s restrictions violated the First Amendment’s protection of the free exercise of religion.

    In a concurring opinion, Justice Neil M. Gorsuch said Mr. Cuomo had treated secular activities more favorably than religious ones.

    This is great news! Thank you ACB for preserving religious liberty. It has been unfair the way blue city mayors and blue state governors have treated religion and believers compared to others during this China caused pandemic.

    A great victory for religious liberty. Hopefully this court will now provide a check on the tyranny of blue city mayors, blue state governors, and our likely next President. No more singling out churches for special abuse by democrats!

    I believe every doctor should be allowed
    To refuse to treat any patient who attends an indoor church session now.

    The failure of the New York restrictions appears to be based upon them having been more severe against religious houses than upon other public venues.

    The problem here wasn't restricting houses of worship, because they are and continue to be hotbeds for infectious spreading, it was that NYC (and other cities) didn't impose and more importantly enforce similar restrictions on secular gatherings.

    Why? Would you accept doctors refusing service to to people who go to a casino or go a strip club or a liquor store? Why the animosity toward believers?

    Are you upset that now blue state governors and blue city mayors now have to treat religious observance equal with everyone else in their executive orders?

    Roberts is worried more about the image of the SCOTUS than he is the rule of law. Take care of the rule of law and the image will take care of itself.

    Cumo is a huge phony that caused the death of thousands of old people. He is working overtime to bankrupt businesses in NY. He could care less about working people. The left keeps ignoring that.

    I also noted that Robert's dissent didn't include any legal argument. It was just nonsense.

    But at the heart of this is the question of why it's necessary for people to gather in churches.

    5 “And when you pray, do not be like the hypocrites, for they love to pray standing in the synagogues and on the street corners to be seen by others.     Sounds like something a Democrat would say. Doctors have oaths to preserve life. Even doctors are required to treat the criminal elements of society.

    Roberts is a liberal for the most part and a great win for religious freedom.

    We got lucky avoiding liberal persecution this time but we know the left will never quit.

    Not going to happen. Separation of church and state. If government had the power to destroy which is what taxation can be, then religion would no longer be independent of government fiat.

    I could really care less what they do in their own mega churches — which by existence alone go against the word of God — I care what they are going to force on others.

    As for taxes. Churches should be allowed to apply for and then prove they are acting as a charitable organization. It should not be automatically given.

    Thomas and Alito will likely be the next two replaced. 12 years is a long time for someone their age. I bet the right will suddenly demand non-partisan judges again.

    I think most Christians will stay home anyways, most do not have faith God will protect them from the virus.. even in a church (did he protect the children)

    Why 12 years? I can see Breyer retiring so Biden can replace him but he’s 12-13 years older than the two you mention.

    No he didn’t. The issue is making sure that churches can operate at the same percentage of capacity indoors as any other group in any other public building and that the limits for outdoor worship events are the same as for any other outdoor activity that people are at.
