Texas doctor says he violated nation's most restrictive antiabortion law to challenge it

    A Texas doctor stepped forward Saturday to say he had performed an abortion that is illegal under the state's restrictive new law to force a test of its legality.

    "I understand that by providing an abortion beyond the new legal limit, I am taking a personal risk, but it's something I believe in strongly," Alan Braid, a San Antonio OB/GYN, said in an op-ed in The Washington Post. "I have daughters, granddaughters and nieces. I believe abortion is an essential part of health care. . . . I can't just sit back and watch us return to 1972."

    Finally... I actually expected this news a lot sooner that this (although he actually performed this on 9/6... not sure why we are just hearing about it now?)....

    So, is somebody gonna sue this guy, or is a straight forward admission enough to make a case? Under this Austinberg Decree, do you need some sort of proof an abortion was performed?

    Regardless of how stupid you feel this law it (and it's really ****ing stupid), watching somebody try and enforce it should be fascinating on many levels.

    Anybody coming after this guy when the courts open on Monday?? Apparently, they're all aware of his actions, possibly even before his op-ed came out from the comments...

    The law is blatantly unconstitutional for many reasons.

    What sticks out to me here would be the appeal process. If court costs are mandated to be paid by the, in this case, the doctor, there is no incentive to appeal. Who's gonna spend $20,000 to save $10,000? And that's just the fine.

    The law seems designed to get people into court, just to serve them a bill. Kinda like paying a parking ticket.

    Breaking the law in protest is acceptable but only if you're protesting on behalf of Democrat causes.

    I don't like abortion. However, I think it is absolutely unacceptable for government, or anybody, to be able to tell someone what they can and cannot do to their body.

    I am also for everyone getting vaccinated. However, I also think it is totally unacceptable for the government to be able to tell someone they have to get vaccinated, for the same reason as above. What someone does to their body should be absolutely no business of anyone except that person.

    Very few "like" abortion.....

    Someday, I'll explain the difference between somebody being in public pregnant vs unvaccinated..

    Yea because we have a designated place to sort out these things. Its like with these howmuchnuffincouldadindudoifadindudindunuffin's trying to fight with cops on the street turning a simple traffic citation into a lethal end, or these anti-masking dipshits throwing temper butthurt baby tantrums in grocery stories. This doctor is no different than either of them because justice ain't carried out on the street. People can follow the damn laws and if they don't like them they can go to the court and make a case, or they can go the opposite direction and get made an example of. To me it seems a clear matter of stupidity defeating practicality.

    I'm pretty sure he didn't do the procedure on the street.... but while the several cases are brewing in the molasses system called the US courts, this doctor (and hopefully others) are ignoring the SCOTUS barfing up their duties and performing his.... This sort of thing IS time-dependent, ya know...

    Which is why I'd like the doctor to actually spill the beans and give me enough info for me to be able to sue him. He's too much of a coward to say anything.

    I made my position clear. Creating some 'gotcha' trap isn't going to change it. Don't like laws? Courts are where you go to challenge them.

    Read the law. Once the claim is made, the accused has to show positive evidence they are not guilty of the claim

    How can someone claim they are harmed if they just “follow the damn laws”? It is, to my knowledge, the only way to challenge the constitutionality of a law.
