Trump administration scores win over challenge to asylum restriction

    "A federal judge decided Wednesday to leave in place a Trump administration rule that imposes restrictions on individuals seeking asylum in the United States if they passed through a third country on their way to the border between the U.S. and Mexico, potentially leading to a sharp reduction in Central American migrants entering the country."

    "With certain exceptions, the rule requires individuals to apply for and be denied asylum in another country in order to apply in the U.S. That means that migrants from Central American nations who travel through Mexico – who make up a significant portion of recent asylum seekers – will not be eligible for asylum in America unless they previously applied for asylum in Mexico or any other country they traversed and were turned down."

    "The rule is meant to crack down on asylum seekers coming to the U.S. more for economic reasons than to escape persecution in their home countries."

    This is a good thing. Our generous "asylum" system is being abused and overwhelmed.

    It will be interesting to see how much this impacts the numbers of migrants, once word gets out that Mexico will likely be their final destination, and not the US.

    Likewise, it will be interesting to see how the US responds if Mexico decides to simply deny all of the "asylum seekers" and send them on to the US instead.

    Between this ruling and the Mueller fizzle, it's been a rough day for liberals.

    But this ruling is a good day for Americans. :D

    If an asylum seeker, in this case central/south America, is really seaking asylum..... why not ask for it once you get in to Mexico? Why do they transverse all cross Mexico then ask for when they're at the border with the US?

    Because they aren't seeking true asylum, as asylum was intended, instead they are seeking economic asylum and/or just using "asylum" claims as a way to short-cut our immigration process. Our economy is stronger, our country wealthier, and our freebies more generous than any country they pass thru to get here. But cherry-picking like that is not how true asylum is supposed to work.

    It's sad that this has become so true.

    Trump’s third-country asylum ban halted temporarily by California judge

    A San Francisco-based federal judge on Wednesday temporarily blocked a Trump administration ban on asylum seekers who pass through another country en route to the U.S.-Mexico border.

    U.S. District Judge Jon Tigar issued a preliminary injunction that will halt the asylum ban nationwide. The move came hours after a federal judge presiding over similar litigation in the District of Columbia declined to stop its implementation.


    In a 45-page order, Tigar found the rule ignored a pair of federal statutes that outline guidelines for barring asylum seekers who transit through a designated “safe third country” or have permanently resettled in another country.

    The new regulation, he wrote, “is likely invalid because it is inconsistent with the existing asylum laws.”

    Additionally, he found that the decision to enact the measure was “arbitrary and capricious.” While it purports to offer protections for migrants, the ban could potentially expose them to grave dangers as they’re forced to seek protection in Mexico or other nations before applying for asylum in the U.S., he said.

    The decision nullifies an earlier legal victory for President Donald Trump, who has sought to diminish the flow of Central American migrants arriving at the border by toughening the asylum process. The administration issued a fast-track regulation last week that bars asylum for migrants who pass through other nations and do not seek refuge in those places. Opponents of the measure quickly challenged it in federal courts, leading to the cases in San Francisco and Washington, D.C.

    Sadly I am inclined to agree at this point. It's sad to see the political sphere I used to belong to have become utterly dogmatic and idealistic as opposed to be pragmatic and realistic.

    I just see it as taking power away from Congress, Congress should be the ones changing immigration laws

    but this will give dems the power to change laws on the books too when they regain power

    Yep, our county is controlled by the 9th circuit (1 damn CA district court Obama judge), ACLU & SLPC. I think we need judicial reform as much or more than immigration reform.

    Send the alien to the judges house. They can drink out of his toilet. They can camp out on his sidewalk. CA can give them free healthcare

    Why are some of you ok with people walking across one country to seek asylum in another? Why are you ok with Africans flying to Mexico then seeking asylum in America? No country allows this why do you want us to do it so damn bad?
