Trump Is On The Verge Of Total Travel Ban Victory

    President Donald Trump’s travel ban will expire Sunday, and that could be the biggest news yet in the legal controversy surrounding his executive order on refugees and migrants.

    The order took effect on June 29 and will expire this Sunday. Per the Supreme Court’s June ruling, migrants from six Muslim-majority nations without a bona fide connection to a person or institution in the U.S. may not enter the country for 90 days. A second provision suspending refugee resettlement for 120 days will expire later this year.

    The New York Times reported Friday that the administration will replace the travel ban with a set of country-specific restrictions this weekend. Accordingly, it appears the White House will allow the order to expire on its own terms.

    The Supreme Court will hear arguments concerning the legality of the order on Oct. 10, but this new development may definitively affect the outcome of the case, as it seems the expiration of the ban will render the controversy moot.


    Federal courts are only empowered to hear ongoing controversies where their intervention will make some difference to the case. A case is rendered “moot” when events render further action on the court’s part meaningless. Since no action the Supreme Court takes after Sunday will affect the travel ban, it would seem that the case should be dismissed for mootness.

    An interesting dynamic comes into play here. As Patricia Millett explained on SCOTUSblog in 2008, when a case is rendered moot while awaiting review by an appeals court, a legal rule called the Munsingwear doctrine requires that the relevant lower court rulings should be vacated, that is, expunged. Millett, then a partner at Akin Gump, is now a judge on the U.S. Court of Appeals for the D.C. Circuit.

    In practical terms, this means that the Supreme Court could dismiss the travel ban case for mootness, then vacate the lower court rulings from the 4th and 9th U.S. Circuit Courts of Appeal, which found that the order was unlawful for both statutory and constitutional reasons.

The travel ban is moot due to natural expiration. No case for court to hear. All earlier rulings vacated. End of issue.

    We need to end ALL immigration from all nations for about 5 years. Only then can we start cleaning up our own house.

    It was a victory the second he got elected. Let's talk about the ratio of terror attacks in the EU/UK to the US since POTUS Trump got elected. And I'm talking about Islamic radicals.

    You've never explained why it's bigoted to want only legal immigrants into this country.
    It's like saying it's bigoted for cops to give people speeding tickets when they're going well above the speed limit.

    My neighborhood is a mixture of immigrants from central Asia, Chinese, Hispanics, blacks, and 19th century Italian/Irish/Jewish immigrants.

    I agree we need to get a control on immigration as do I think most people, the issue we have is with people that have lived here all their lives and know no where else, it's just not humane to toss them out at this point

    I still think the best way to do this is by making it a felony to knowingly hire an illegal, if a corp knowingly does it, they forfeit their corporation to the government like a drug dealer, if it's just local management, they go to prison

    it's bigoted for cops to only give one race tickets for speeding and ignoring everyone else or to only pull over poorer looking cars and let the richer looking folks have a free pass... we expect justice to be blind in that regard, equal for all

    trumps original issue was he called it a Muslim ban.... banning based on religion

    be like calling the wall a Christian ban from Christians from south of the border.. saying that would make sure the wall was never built

    It's not limiting Muslim immigration, per se. It's holding off on immigration from lands that have produced jihadis. That's just smart planning.

    Why do you want them here? They don't like our customs and traditions, their religion doesn't jive with our values, they don't habla and they smell awful. Immigration is supposed to benefit the United States, how will these people contribute?

    Trump's ban doesn't make sense other than it's targeting some Muslims

    Why isn't Tunisia, Saudi Arabia, Russia, Morocco and Jordan on that list... they produced the largest amount of ISIS fighters?

    Why is Iran and enemy of ISIS being targeted... when it's basically a threat to Israel via Hezbollah?

    I don't think people realize that companies , by law, have to take the word of the job applicant. If they are notified a social security number has red flags or can't be found....legally they can not fire the employee. They fill out the appropriate paper work and send it in...to the government. Their hands are tied. Our government had set things up where illegals have the right to work here...possibly with someone else ss number.
