Just like how the right to bear arms is self evident yet we needed District of Columbia vs Heller to establish people have the right to own guns in their own home for self defense.

Dread Scott vs Sandford and Plessy vs Ferguson both established that African Americans didn’t have the same rights as everyone else. And don’t forget the Japanese in Korematsu vs United States, same story. Since their rights weren’t “self evident” does that mean that they aren’t valid rights?

What about Brown vs Board of Education? Was African Americans rights to go to the same school as everyone else not “self evident”?

Education was never included in the constitution prior to those decisions.

Had you asked why a non right was created into a right, we have something to discuss.

 

My point is your argument that we don’t need court cases to establish rights because if they actually were rights they would have been self evident is demonstrably false. The rights of African Americans weren’t self evident when the country was founded even though they clearly are. It took court cases after the fact to establish those rights.

“Slavery was legal per the constitution” Exactly! Is it not self evident that people have the right to not be slaves? Does that mean that since they didn’t establish that right when the country was founded because it wasn’t self evident it isn’t actually a valid right?

Your claim that “we do not need more laws to show speech is a right” is wrong since we had to have District of Columbia vs Heller to show gun ownership is a right even though we already had the second amendment.

Your making the argument that since there had to be a court case over ones right to their own body and it wasn’t “self evident” it shows it isn’t actually a right which is absurd.
