    Here’s the law that sandy absolutely knowns nothing about.

    The Act empowers the President to activate special powers during a crisis but imposes certain procedural formalities when invoking such powers. The perceived need for the law arose from the scope and number of laws granting special powers to the executive in times of national emergency. Congress can terminate an emergency declaration with a joint resolution signed into law.[1] Powers available under this Act are limited to the 136 emergency powers Congress has defined by law.[2]

    The legislation was signed by President Gerald Ford on September 14, 1976.[3] As of February 2019, 59 national emergencies have been declared, more than 30 of which remain in effect.[1][4]

    prior Senate investigation had found 470 provisions of federal law that a President might invoke via a declaration of emergency.[14] The Act repealed several of these provisions and stated that prior emergency declarations would no longer give force to those provisions that remained. Congress did not attempt to revoke any outstanding emergency declarations per se, as these remained the President's prerogative under Article Two of the United States Constitution.[15]

    The Act authorized the President to activate emergency provisions of law via an emergency declaration on the conditions that the President specifies the provisions so activated and notifies Congress. An activation would expire if the President expressly terminated the emergency, or did not renew the emergency annually, or if each house of Congress passed a resolution terminating the emergency. After presidents objected to this "Congressional termination" provision on separation of powers grounds, and the Supreme Court in INS v. Chadha (1983) held such provisions to be an unconstitutional legislative veto,[16] it was replaced in 1985 with termination by an enacted joint resolution. A joint resolution passed by both chambers requires presidential signature, giving the president veto power over the termination (requiring a two-thirds majority in both houses in the case of a contested termination).[17] The Act also requires the President and executive agencies to maintain records of all orders and regulations that proceed from use of emergency authority, and to regularly report the cost incurred to Congress.

    Certain emergency authorities were exempted from the act at the time of its passage:

    • 10 USC 2304(a)(1) – allowing exemption of national defense contracts from competitive bidding
    • 10 USC 3313, 6386(c) and 8313 – regulating the promotion, retirement and separation of military officers
    • 12 USC 95(a) – regulating transactions in foreign gold and silver
    • 40 USC 278(b) – regulating federal property purchases and contracts
    • 41 USC 15 and 203 – limiting the assignment of claims against the federal government
    • 50 USC 1431–1435 – enabling the President to make national defense contracts outside of otherwise applicable rules
    The list of exceptions has from time to time been revised. For example, Public Law 95-223 (1977) repealed the emergency clause of 12 USC 95(a) and arranged for its authority to expire according to the normal provisions of the NEA.

    Where did you come up with that B.S.? Do you have a source for that gem or did you just make it up?

    No one here is talking about changing a law. We are talking about a Constitutional crisis.

    Simply because I accurately report on what Trump does and says does not mean I hate him. I barely know the man. Don't change the subject. This has nothing to do with hate and you know it.

    Point one you gave me that one good for you.

    Point 2, why else would they write it so open ended? I'm applying simple logic to a small puzzle. The question is, "if they didn't want the president to be able to do an end run around congress why the hell woul they create enabling legislation to allow Presidents to do that very thing?"

    Point three, you are crying wolf once again. There is no constitutional crisis here unless you consider congress' abdication of it's duty to defend the country a constitutional crisis.

    Point 4 got a better reason for your Trump monomania? Your strange inability to discuss anything at all save as it relates to Trump.

    We need to carve this threat into granite and post it on Facebook every few days. The Trumpet's rationalizations and justifications of this ersatz "emergency act" is funny if not downright hilarious. It clearly demonstrates, once again, that long term thinking for Trumpets is roughly noon tomorrow. A majority of people approve the wall is a lie doesn't rise to a point of discussion.

    What really burns Americans posterior is that over 40,000 Americans die at the end of a gun barrel every year. 91% of us think stricter gun laws are needed. Now that's what a national emergency looks like - 40,000 fellow Americans dead.. Roll the clock ahead a few years when a Democrat takes over the White House. Think said president would use the "national emergency line to get the gun regulation 91% of Americans want. Bet your first born on it. Then listen to the Trumpet's sound!

Talk about pretending there isn’t a problem and hoping it goes away. You choke by making absurd statements about things like immigration when you are ignorant of the realities. All you know about these subjects is what someone is feeding you. I suggest you venture down from your ivory tower and do a little research on how illegal immigration is actually impacting the country. And no I don’t mean reading CNN, MSNBC, etc. You need some real world experience and knowledge Sandy. Until you get some you are just parroting progressive/globalist mantra. Doesn’t sound like a conservative Constitutionalist to me.

    I suppose I shouldn’t be too hard on you. It has to be frustrating to spend so much time here posting propaganda and have CNN come out with a poll where Trump’s disapproval ratings are at all time lows. Apparently more and more people are seeing through your propaganda.

    It also has to be really galling for Trump haters to have to resort to the memes about Trump not stepping down if he loses the next election. I mean he was supposed to be impeached and in prison long before 2020. Such fearmongering reeks of unhinged desperation.

    You know what probably accounts for so many getting wise to your spin. Everyone eventually gets tired of being marketed to on the basis of fear. Every post and news story is an amalgamation of chicken little and the boy who cried wolf. Eventually, as everyone’s lives improve under Trump, and the sky doesn’t fall, and the wolf turns out to be an adorable puppy, your tripe loses its appeal.

    Congress has done what it can to stop Trump. Unfortunately for you the legislative branch of government isn’t dominant over the other two. Thankfully for the country we have a chance at actually solving this immigration problem. Thankfully congress can not stop Trump from carrying out his constitutionally mandated duties even if they refuse to carry out their own.

    A leftist will do this eventually whether or not Trump ever even broached the subject of an emergency.

    You also fail to see this emergency is to facilitate accomplishing a constitutional mandate. Your hypothetical would be to facilitate direct violation of the Constitution. I don’t see how there is any comparison between the two.

    Now, if a future president declared an emergency to fight crime and decrease suicide you would be in the ballpark.

    I’m not too emotional about these things. Just reporting facts as Sandy would say. The numbers are going the wrong way for you guys. Better get him impeached quick. :)

    The black guy...odd turn of phrase. If you mean President Obama you may want to overlay approval ratings with positive/negative press coverage data before you get too carried away. Probably too complicated of a subject, never mind. Just keep parroting the party line.

    The numbers speak for themselves, and your supposition about coverage conveniently leaves out the question of whether the actions covered were positive or negative in and of themselves. Hard to put a flaming dumpster fire in a cheerful positive light unless your name is Spicer, Huckabee-Sanders or Conway. Context matters.

    Yeh, I guess authoritarians would prefer “the Black guy” and report positively on his foibles. That’s really what it boils down to. You prefer an authoritarian state and I prefer as much freedom as I can get.

    How do you explain Trump’s poll numbers improving in the face of negative media coverage? Is Sarah Sanders just more convincing than Maddow?

    The term for the tactic you're so blatantly attempting is cherry-picking. Other polls from the same time did not show the same results. Rasmussen showed a two point increase in his disapproval rating and a two point drop in his approval rating for the same time period. The aggregate average from RCP for the same time period shows the same trend - disapproval up, approval down.

    Pop quiz:
    • What do we call a data point that does not show the same trend as all of the others in a set?
    • What do we call a conclusion that focuses entirely on that single data point while utterly disregarding all the others?
    • How do we evaluate the credibility of one drawing said conclusion by using ad hominem attacks when questioned on their data and methodology?

    Anyone?

    You are welcome to show the error of CNN methodology. You are also welcome to explain why progressives call Rasmussen the least reliable poll when it suits their purpose.

    I simply brought up CNN because it was a recent poll that was heavily in the news this week. And CNN is advertised by progressives as infallible. Your point on aggregate is valid if you accept credibility of all polls which you seem to do at this time.

    If you took my post as ad homenim the fault is mine. I was simply trying to make the point people/media who praise President Obama and trash Trump ignore the fact Obama decreased freedom and Trump has increased it. If you don’t like that fact I don’t know what to say.

    Per post #86 ... Let me direct you to my reply #44 and suggest that you carve that in granite. Democrats think weak scare tactics can discourage the POTUS from exercising his authority, but they haven't. In the event that the "next (D) president" proposes a dreadful declaration, (R)'s must simply rise to challenge of passing a veto proof resolution. If not, accept that they have to wait until the "next (R) president" rescinds the declaration.

    Who are you to define what a "true Republican" is?

    Here is a fact - the true Republicans are those who support the wants, needs and demands of the party rank and file - since it is the electorate who determines what ideological direction the party should follow by voting for the candidate of their choice. Your so called "true Republicans" are hacks who are unhappy at losing to a candidate and icon who is changing the face and ideology of the old line neo-con Republicans to a more FDR/JFKcentric party with conservative principals based on Capitalist Keynesian policies and programs that are more in line with supporting the American dream for ALL Americans without dividing those Americans into the various racial, ethnic and religious camps opposing and hating each other over some fake new manufactured wedge issue.

    Look at the way they've managed to twist something clean and pure such as the support for Traditional American values and the American dream into accusations of racism, sexism and islamophobia while all of the hate I see come from the fake news and the Democrat Congress.
