This administration developed a plan for reopening our economy. It includes 3 phases with gating criteria on whether we're ready to enter any of these phases. Among the requirements there are requirements on Employers for each phase.

    https://www.whitehouse.gov/openingamerica/#criteria

Obviously, an employer could open up in a way that doesn't follow these criteria or the employer requirements for the phase of openness they are implementing.

If an employer fails in that way and there is evidence that it led to employees getting sick, can they sue the employer?

Or, is this plan just a bit of advisory nonsense?
