    The Circuit Court of Cook County in Chicago has agreed to hear a lawsuit on Sen. Ted Cruz's eligibility for president — virtually ensuring that the issue dominates the news in the run-up to the South Carolina primary.

    Cruz was born in Canada to a US citizen mother and a noncitizen father. The Constitution requires presidents be "natural-born citizens," but what exactly that requires hasn't been settled in court.

    Now, perhaps, it will be. The lawsuit in Illinois aims to resolve the question by challenging Cruz's eligibility for the presidency. It was filed by Lawrence Joyce, an attorney who has told local media that he supports Dr. Ben Carson and has had no connection with the Trump campaign.

    "Joyce said his concern is that the eligibility issue lie unresolved during Republican primaries, thus letting the Democrats take advantage of it after a potential Cruz nomination, when it’d be too late," reports The Washington Examiner.

    My take;

    Born in Canada
    Canadian birth certificate
    Immigrated to US when he was four
    Only renounced his Candian citizenship in 2014

    He is NOT a Natural Born Citizen, he is a Naturalized one.

    He is NOT eligible to run !

    Not so sure. This line in the article makes a good point about why it needs to be looked at now rather than later.

    Now obviously if you were a Democrat hoping to see Cruz get the nomination, then try and take him out with this...then yeah, it sucks to ahve this one pulled out from under you I guess. Not sure how it will turn out, but better to put it to rest now IMO.

    We've already shown our national disinterest in where a person is born where election to the presidency is concerned. To this day you can find very convincing documents and supporting narratives to indicate that Barack Obama was not a "natural-born" citizen of the United States.

    How odd. I've been cursed as "a birther" for years for even bringing the subject up, or showing copies of Obama's Kenyan birth certificate, or pointing out numerous fallacies and inconsistencies in the "Hawaiian birth" story line, documents, the "tale of two hospitals", etc. But now it's all some big deal if Cruz was born in Canada? I'll say the same thing to you about Cruz that I heard so very often when I'd beat the drum about Obama -- "who cares...?" :smile:

    LOLOL.. are you still talking about the name of the hospital? Read the history of the hospital and its expansions since 1961.

    This birther stuff just gets more and more ridiculous.

    My hunch is that it's going to take a direct opponent to file a lawsuit in order to be able to show personal harm.

    But this definitely isn't "settled law". The McCain situation was very different because he was born on a US Naval Base.

    There has never been a situation quite like Calgary Ted's, and the natural born thing needs clarification.

    Of course, if Republicans continue their expected SCOTUS intransigence - it'd end up a 4-4 tie and nothing would be resolved.

    McCain was NOT born on the naval base... but both his parents were US citizens so he's a natural born US citizen from birth.. You don't have to be in the military.. You can work for GE or ARAMCO, teach school etc.

    Ted was a US citizen the second he was born, as per federal law.

    First off Cruz is irrelevant.

    Then there is this....

    All the sources routinely used to interpret the Constitution confirm that the phrase “natural born Citizen” has a specific meaning: namely, someone who was a U.S. citizen at birth with no need to go through a naturalization proceeding at some later time.
    And Congress has made equally clear from the time of the framing of the Constitution to the current day that, subject to certain residency requirements on the parents, someone born to a U.S. citizen parent generally becomes a U.S. citizen without regard to whether the birth takes place in Canada, the Canal Zone, or the continental United(*)States.

    The Supreme Court has long recognized that two particularly useful sources in understanding constitutional terms are British commonlaw and enactments of the First(*)Congress.
    Both confirm that the original meaning of the phrase “natural born Citizen” includes persons born abroad who are citizens from birth based on the citizenship of a parent.

    I agree - but he is a Naturalized citizen, not a Natural Born. It's obvious the Founding Fathers believed there was a difference as the two terms wouldn't exist otherwise.

    if you are born of a US citizen on foreign soil, you are a citizen at birth, as per federal law.

    I could be mistaken as well, but it seems to me that the birther argument at the time was that he was born off base... which makes NO earthly difference.

    This won't matter....

    what will matter is tomorrow in South Carolina.

    If Cruz comes in 3rd behind Trump and Rubio?....and then it looks like he'll do it again next week in Nevada?.....he's finished.

    Apart from Cruz winning Texas and maybe one, two other states...Trump would win every State on Super Tuesday, March 1st.
