    How do you know the man on the ground did not fear for his life? People who think it is not a life or death situation have never been on the receiving end of an attack like that. When you are on the ground after being knocked do violently have no idea what might be coming next. Maybe if the guy pushed down was Jean-Claude Van Damme he would not have been in fear of his life.

    I'm just wondering what constitutes a grave enough threat in the mind of fearful right wingers to warrant deadly force. I don't know if it was you I was responding to but whoever it was said any violent assault made it okay to respond with deadly force. Well a slap is technically a violent assault and as ridiculous as the notion is to you of responding to a slap in the face with deadly force, so to me is the idea that a gun shot is the appropriate response to a shove.

    The attack didn't persist because the guy drew his gun and fired. We don't know what would have happened if he didn't draw a gun.

    I grew up in Miami. I've suffered worse attacks than shove.

    But we do know once the gun was drawn the guy started backing AWAY from the shooter. Backing away from someone is the opposite of aggression. It's the opposite of a threat.

    "There is a pause — even if it's only for a couple seconds — there is a pause between the time Drejka hits the ground and he shoots. That pause gives me pause," Gualtieri said. "That pause gives me some concern. And it goes back to what I said when I opened: just because you can, doesn't mean you should."

    Criminal defense attorney Anthony Rickman says the fact that McGlockton backed up after the shove raises concerns.
    "The question is, at that point in time, was there the possibility of imminent serious bodily injury or death of Drejka that justified the use of deadly force? And after watching that video, I don't think so," Rickman said.

    I can assure you that if you suffered worse attacks than that you did fear for your life. You have no idea what would bring someone else to that fear.

    Oh please. Fear my a$$. He's an old handicapped man going around confronting people in an aggressive manor. The only old people who do that are ones carrying a gun looking for trouble.

    If you were shoved down like that would you be thinking clearly or would you be asking yourself what comes next from the attacker?

    Yep. And when the SA declines to prosecute, all of the people whining and crying about this being a murder will start screaming about racism.

    The shove is not what is important, it is the result of the shove that is important. If the man had just shoved him over a step or 2 things would have been totally different but he was shoved down violently to the pavement. The attacker stepped back only to regain his balance so there was no retreat from him until he was shot.

    When I'm elderly I'm not going to go around confronting people in an aggressive manor. Especially people more than half my age. Therein lies the difference. He was looking for an excuse to use his gun given his history.
    That being said...we ALL clearly see the guy taking steps AWAY from the shooter once he sees the gun. Only someone whose intent was to shoot would take the shot at that point. Most normal people who aren't looking for confrontations like this would use the gun to scare the person to get them to move back and not be a threat.

    The assault you saw in the video is sufficient for any reasonable person to believe they (and thus, the shooter) may be in danger of further bodily harm or even death.

    And all the people who support the shooting will still be happy a white man killed a black man. See, I can make ignorant sweeping generalizations too. Isn't it fun???

    Really, pointing out to a driver that they are parking in a handicap space illegally is looking for trouble. I am old and carry a gun visibly on my belt for protection and always mind my own business. If the guy coming out of the business had only talked first nothing would have happened but he resorted to violence.

    Another Circle A customer, Rick Kelly, told NBC affiliate WFLA that he encountered Drejka in a similar situation a couple of months ago. Kelly said he had pulled into that same handicap spot and Drejka began inspecting his decals to see if he had the right to be there. The situation escalated.

    "He was basically threatening to shoot me that day," Kelly said.

    And in 2012, Tyler Smith, 18, accused a driver later identified as Drejka of hanging a gun outside of his truck window during a road rage incident in Palm Harbor, northwest of Tampa, according to law enforcement documents obtained by NBC News.

    Smith, whose account was corroborated by his passenger, told a Pinellas County sheriff’s deputy that Drejka began yelling and honking at him when he stopped at a yellow traffic light, the documents say.

    Smith said Drejka then dangled a black handgun from his driver’s side window and placed two magazines on his truck’s dashboard. After Drejka followed the car, the passenger told the deputy, Smith called the sheriff’s office to report him — though he didn’t want to press charges, according to the documents.

    During an interview with deputies, Drejka said he’d yelled at Smith and honked his horn after the car cut him off, the documents say. Drejka denied following the vehicle or displaying a Glock that he kept in his truck’s center console.

    The amount of time it takes once the gun is drawn does not allow for the mussels to stop the trigger pull. When pulling your gun you have 2 choices either shoot or don't shoot and the choice is made when you pull your weapon.

    His past can be brought in on a civil suit later on but as for this incident it is self defense.
