The Heller ruling specified both that firearms ownership for matters unconnected with militia service is a constitutional right, and the total prohibition on handgun ownership implemented by the district of columbia failed constitutional muster under any and all standards of scrutiny.
Scalia himself stated that that ruling does not mean a particular firearm can't be banned from civilian use.
Show where such has actually been stated on the part of himself. If it is not a statement found within a united state supreme court ruling, which actually has the weight of law, then it ultimately means nothing.
he has been told that several times and asked what other laws he wanted that would have stopped the shooting, since he is using the shooting to justify more harassment of lawful gun ownership.
How would any of those laws stopped the recent mass shooting? I believe the shooter went through a background check, so that did nothing to prevent the shooting. He went through the background check in order to get a gun license. So having a license didn't prevent the shooting. Registering his guns? Ok fine...but how would that have prevented the shooting? Majority of mass shooters aren't worried about getting caught since most tend to off themselves at the scene. So registering his guns would not have prevented the shooting.
Here's my plan: Disband the National Guard, or simply fold it into the regular Army Reserve, and replace it with a restoration of a true citizens' militia. All American schools would teach Civics, teaching students their rights and responsibilities under the Constitution. Firearms safety training would begin early, to help "gun proof" the kids, and would dramatically reduce firearms accidents. Martial rifle and basic field survival training would be part of every school's curriculum beginning in high schools. After graduation, ALL American citizens would serve two years of active militia service. Those with conscientious objection would simply be assigned to support roles as mechanics or medical personnel. Militia would act to support emergency services, assist First Responders in crisis situations, and supplement Border security. They would be issued proper armament they would keep with them in their homes, ready to deploy on a moment's notice, and after their two year active service would still be subject to recall in emergency situations. Upon completion of their two-year commitment, militia veterans would then have opportunities to stay with the militia, transition to active military, or be accepted for training as law enforcement officers. Those who complete their two year militia commitment would receive assistance to facilitate education as well as technical training for careers they wish to pursue, and would be eligible to buy any firearm they wish; as well as be allowed to keep their service weapons. All citizens would participate either in annual drills to demonstrate they have maintained proficiency, or they could choose to engage in quarterly qualifications. Concealed carry would be automatic following completion of service. Those who pursue more advanced training on their own time would be given service incentives for it. Clearly, while in service, mental health evaluations would be part and parcel to their basic medical. Those found psychologically unfit would clearly be discharged for mental health treatment and barred from purchasing firearms. This would address the problems of identifying those with mental health issues. People would, of course, have a greater sense of community with their fellow citizens as all would be serving or have served. Firearm ownership would be the norm rather than the exception, and proper firearms handling and safety knowledge would be universal. People growing up in the inner city would have access to better education and employment opportunities, which means fewer inner city residents would be prone to turn to crime. Criminals would know that everyone they might think about targeting would be a trained and most likely armed target, and there would be a deterrent effect. Those criminals not deterred would most likely already be on the radar of law-enforcement due to their predilections during their service; especially if they were discharged dishonorably from the militia. There. That's my plan. Discuss.
Its a very interesting plan and thank you for presenting it in such detail. I agree with it completely and think it would provide us with a TRUE WELL REGULATED MILITIA. It seems very similiar to the swiss or Israelie model I believe. I personally I might add some other elements to have a more comprehensive plan but I do not think what you presented is a bad plan in any way. Not a complete plan...in my humble opinion....but a very good plan that would not only build a stronger nation but help a lot of young americans get a good start in life by learning discipline, duty and honor. Well done Sir.
Nothing can prevent every shooting. But we can reduce them and make them much less likely. A better system....not a perfect one
well when the brady waiting period sunsetted in favor of the Instant BGC and the Clinton gun ban went away in 2004,the rates of violent gun crime continued to drop so you are WRONG.
Those laws wouldn't have prevented a majority of the mass shootings since we always find out the majority used legally owned guns. Legally owned guns means they went through a background check.
Untrue. For years the violent crime rate in this country has been going down even as the laws have been loosened. Epic fail.
He was a trained soldier. You can change a magazine incredibly quickly as a layperson, much less with training.
So? The VT shooter had ten round mags (CA capacity) and killed 32 people. And correct me if I'm wrong but his mag was illegal, yet he still had one, right? I mean...if it was illegal then that should have prevented him from obtaining it, right?
