Just saw on the local news that the dead man was hit multiple times, not once. A neighbor said that the pipe or fence post that her neighbor hit him with was bent out of shape afterwards.

This sort of thing could be avoided if we just do some common sense regulations concerning heavy metal objects! If it hadn't been just laying there this poor wannabe criminal might have survived and been shot with a firearm like a real criminal..

That changes the story, but still not enough to determine what happened.

Untrue, in Tx we can shoot them in the back as they run if certain conditions are met.

How can so many posters be so quick to make judgement for or against the homeowner, without knowing all the facts.

I'd like to know what the Coroner's report had to say. What was the metal object? Was he struck once or multiple times?

Edit … just saw Steve N's post.

If you assault somebody that is a felonious crime and if you kill someone in the course of that felonious assault that is felony murder. The idea is to prevent just what is happening here

The article says the man was taken into custody and expected to be charged.....so what is the problem here?

Who cares if some criminal is pushing up daisies?

Anyone with two brain cells should know that you are headed for trouble, legal or otherwise, when you chase down a suspect and get into a fight with him. The proper course of action would have been to call the cops with a description and the suspect's location. The homeowner committed first degree murder.

Hmmmmm, good point. We all know that shooting someone in the back is just as bad as punching a sheila in the face. But what about being thonked on the back with a pipe? Isn't that less brutal than a pipe in the face?

Depends on how many times he hit the guy. If the citizen was trying to place the crook into custody on a citizens arrest, the crook resisted and the man hit him once.....it's involuntary manslaughter. We'll have to wait for more facts.

If in Texas, at night, and the bad guy has your belongings, and you don't know him or her so there is little chance of recovering the stolen property, no problem shooting them in the back. Don't let them get down the street though.

Or after seeing that the crook couldn't outrun a 54 year old man crook stops running and swings at the elderly guy and elderly guy swung back, with a pipe.

Okay...at what yardage down the street can you lawfully shoot the felon in the back?

Ford said, adding that she heard George’s wife say: “Oh my husband. He’s getting ready to kill him. He’s getting ready to kill him.”

This is quite important. Perhaps their house has been targeted before and if so I understand fully his reaction to it, but he will be charged with murder.

Murder? Screw that. Give him a letter of appreciation for ridding the streets of a piece of human garbage. I have zero sympathy for the burglar.

Be best if you don't let them leave your yard, but you will have to convince a grand jury that you had no other recourse or else your goose is cooked.

I think he hit him the burglar alot more than one time. If I were on the jury I would probably let him walk, I don't have much empathy for cat burglars. It depends alot on George's prior history. If he has a clean background and is gainfully employed, there is no reason to destroy his life over this. Given the problems in many inner-city black communities, perhaps a little vigilante justice is needed to put the fear of God into the local predators.

Indeed. But he should request a jury trial and give it a shot.
