Given our resistance to these measures now as profoundly anti-American to our culture, there's no way(whether it would have clearly been better or not) we would have accepted them at a time of few cases. Trump's attempts to reassure us was poor, but it came from a good place.

You *can* sue, but you're not going to win. You cannot exclude any other reasons for the victims to have ventured out. You'd have to literally find maybe a text or a recording that said "Fox news said it's a political scam, and I believe fox news.". The odds of finding said text as the sole only reason are slim to none.
