His wife got into an accident (she doesn't drink nor do any sort of drugs) and the cops follow her into the emergency room trying to give her several sobriety tests while she had a concussion.
afaik an officer can obtain a warrant mandating a blood test, which is usually granted stat if a suspect refuses, and which is definitive as to DUI or not. Being right there at the hospital that would have been the best way to handle it imo -- if an officer truly suspected DUI reasonably. One question: was she offered the breathalyzer, and did she refuse it? There's a lot that's unknown here but it looks bad for the officer. You cannot trust the news these days, either.
That sounds pretty lame. Like one of those things where they are so wrong they just write crap to try and be right.

Looks like a major overreach by the local cops. I hope this publicity will get the police chief to implement some additional training classes.
Had a cop once pull me over, and command me to stand on one leg, lean way back, close my eyes and with hands outspread, touch my nose, while reciting the alphabet backwards. I was so pissed, that I did it perfect, even though I had blown a doobie.

Being that she was in an accident, I assume the ticket for failure to maintain a lane is pretty minimal.

She was in an accident, had a child in the car who as not properly restrained endangering the child and had to go to the hospital. Well I think that's going to get you a sobriety check doesn't matter what the husband says about her not drinking and don't interfere with an officer and answer questions they are asking someone else..
