The assumption that he 'will' try to override States is an assumption. Just because he said he believes that it should stop on election day, doesn't mean he's going to take it to court. If he does, then that is on him, but people who speak (post) like they know it for fact, will likely find themselves a bit embarrassed down the line.
He's said he's planning on send lawyers for exactly this scenario, so that sounds like trying/willing to take it to court.
