OSHA has no granted authority to mandate medical care to an entire working class of Americans. This will fall flat in court. They can’t target a whole working class like this.

The bottom line is OSHA has mandated vaccines for workers but as far as I know it’s only in the medical field. This I am sure is outside of their designed and historical scope. It will never win a court battle

 

Time will tell. OSHA's intent is to provide you a safe environment to work in. Wouldn't COVID free be considered contributing to safety by reasonable people?

 

It might get shot down, but I'm sure the calculation Joe is making is that it will take a while before it is litigated and rises to the SCOTUS, and, in the meantime, he figures he can get a handle on the pandemic.

 

They can require ppe, engineered prevention measures, and administrative procedures in the workplace but not medical procedures. The scope of medical procedures extends beyond the workplace. Ppe can be removed when you go home. Medical procedures effect your body and you cannot undo it when you go into the privacy of your home.

I think people should get the vaccine, but I do not support the Govt forcing employers to force their employees to get it. This is beyond the scope of the Govt at any level.

 

You are correct, COVID will never go away, the goal has to be to get it to be no less dangerous than the annual flu. The vaccine will go a long way towards doing that.

I'm sure there will be an exemption for medical reasons. That's how the mandate works at our university. Roughly 5% of students have an exemption, the other 95% are vaccinated.

Second, if you don't want the vaccine, get tested once a week. I haven't heard of anyone dying or getting sick from taking the test.

So, despite the RW trying to paint this as an authoritarian power grab, people will have options. Just like with the seat belt mandate. if you don't like wearing a seat belt, don't drive.

 

It’s intent is clearly authoritarian in nature. It’s also outside of OSHA’s historical scope. Your college can do it. It’s legal for companies to do. Nowhere in the constitution does it grant the federal government authority for this. It will be shot down. I would bet a paycheck on it

Another not talked about part of this is we do not have the capacity to test them all weekly. That is waht the VA was supposed to be doing with those who choose not to get it and there just is not the system in place to test that many people weekly.
