How would it be? It is a credit (the Feds giving out money) simply for having (not necessarily birthing a child here) a child here. The credit was never intended for persons who are not resident here (per US Law 1986, an illegal can not be nor is recognized by any state or the Federal Govt as being a resident in the US).

Whoever wrote the article on the Washington Times does not know tax law. The article was partially correct describing the eligibility requirement for the EITC and how illegal aliens are taxes. There are several tax issues that are in play here and it is not a loophole. The first question is the definition under Title 26 on what is considered a resident alien for tax purposes. Under the code, title 8 and Title 26 have different definitions. Under Treasury Regulation 301.7702-2, an alien can be considered a resident alien for tax purposes if they meet the substantial days present test. If they do, they are treated, for tax purposes only, as U.S. citizens and must report worldwide income.

That being said, they need a valid taxpayer identification number. If the alien is unable to obtain a valid SSN, the alien may qualify for an ITIN. If they qualify for an ITIN, certain credits may not be available because it is specific in that code section for the credit.

That part the article got right. Where it goes wrong is an IRS procedure, in place since 2002, that if a person files a tax return but is ineligible for simply not having a valid SSN, then they may file an amended return to claim a credit once they become eligible for a SSN, as long as it is within the statue of limitations for claiming a refund.

The rule does not mean there are special or new tax credits available for illegals. The rule is there for those who were not eligible simply because the proper TIN was not available. The procedure is more broad based than just for illegals. It is available for almost any circumstance when a valid TIN is not available, for almost any reason.

Save voting, what do they really lack? I can think of many things gifted to illegal aliens that are BETTER than that of citizens.

They get unlimited ER health care for free. One ER trip last month cost my son $2000 AFTER insurance.

They are exempt from low level law enforcement because the rapacious state KNOWS they will not pay fines and represent a net loss while citizens are a revenue source.
