    I like with the principle that the legal system should focus more on intent rather than outcome when prosecuting criminals, though predictable outcomes should be included to. You need to cover wanton negligence as well as malicious intent. Of course, all of that would require a massive intellectual shift in how the system works and how we all view it and that would be a difficult sell politically.

    Well the details aren’t clear but it sounds like the thieves were outside trying to steal his car when he went out to confront them so it’s possible that by remaining inside and calling the police immediately, he may well have prevented the confrontation, including having the knowledge he killed someone on his mind.

    “The teens were charged due to them being in commission of a forcible felony, when the 14-year-old victim was shot and subsequently died as a result of being shot during the commission of a burglary,” according to a Tuesday night news release from the Lake County sheriff’s office.

    Illinois law allows for authorities to charge suspects with murder if someone dies during the commission of another serious crime. Known as the felony murder rule, the statute has proved controversial, particularly when it is used to charge juveniles.

    No problem here. I walk around, sleep at night and do not fear being shot at. Burgled......well it's never happened to me. It is also pretty rare when the occupants are home. Burglars want your stuff, not your Life.

    In Wisconsin, the felony murder rule is found in Wis. Stat. Sec. 940.03 and was last revised in 2005. Generally, the statute applies to dangerous felonies, felonies that have a propensity to cause great bodily harm, or those that involve a dangerous weapon or even a facade of a weapon. Sentences adding felony murder are enhanced by a maximum of 15 years, plus whatever the maximum of the underlying felony awards.[1]

    Crimes in the felony murder statute in Wisconsin are:

    • battery, including that to an unborn child
    • Sexual assault of the first degree, or second degree if it is by use or threat of force or violence
    • False imprisonment
    • Kidnapping
    • Arson of buildings or damage of property by explosives
    • Burglary with a dangerous weapon, explosives, or burglary of any inhabited dwelling
    • Carjacking
    • Robbery with a dangerous weapon, or even with an object that leads someone to believe there is a dangerous weapon
    Robbery and possibly carjacking would be comparable in this case.

    The area where the shooting happened does not have a police force. The sheriff's department patrols it.

    "Old Mill Creek, a rural area with a cluster of historic homes surrounded by large equestrian farms, had only 178 residents as of the 2010 census. The town has no police force, so depends on the sheriff to patrol the area."

    In this particular instance, the teens confessed that they drove to the area for the express purpose of committing some crimes. They were in the process of doing that when they were discovered. The guy who did the shooting is under investigation. I doubt he will be charged given the circumstances, but it is possible that he could be.

    ILLINOIS STATUTES
    According to Illinois Law 720 ILCS 5/9-1, first degree murder is defines as the intentional killing of another person, the infliction of great bodily harm knowing it could lead to death, commits an act that has a strong probability of causing death or great bodily harm, or occurs during the perpetration of a forcible felony.

    Illinois Law 720 ILCS 5/2-8 lists forcible felonies as sexual assault, robbery, burglary, arson, kidnapping, aggravated battery, and any other felony that involve the use of or threat of physical force or violence.

    What this means is that you could be charged with first degree murder even if you don’t intend to kill anyone, but are involved in any of the crimes listed as a forcible felony. A death sentence can follow a conviction of murder if certain aggravating factors exist. Relevant to Felony Murder would be the killing of a police officer or fireman while on duty, actually killing a person while committing the felony, inflicting injuries along with other felons that caused a death, or committing an inherently violent felony.
