Nah, I am celebrating the win though.

 

Is anyone else troubled by the person who told the dispatcher that there were shots fired? He probably had to to convince the dispatcher it was worth while to send cops. That changed the message from "check out a disturbance at the mall" to "All cars head to the mall, shootings in progress."

 

This isn't about a citizen, this is about a uniformed officer of the law in an active shooter situation with civilian casualties in need of immediately medical help and people still tramped and immediate danger, until you can stipulate that there is no point in further discussion you keep trying to minimalize the circumstances.

 

It will be investigated, and the decision will be made to determine if charges are warranted.

It would seem to (at a bare minimum) fit the elements of Negligent Homicide.

 

What was the negligence it was a ricochet shot, again this is about a uniformed officer of the law in an active shooter situation with civilian casualties in need of immediately medical help and people still tramped and immediate danger. You are saying he shouldn't have taken the shot, he could not see a civilian behind the target, he had one target in his line of fire and again it was a ricochet shot.

They were operating on a report of an active shooter, that was their circumstance, they stop by all necessary force. How was this survey to be done and when?

 

How were they suppose to "survey" and when? They have injured bleeding people on the ground an active shooter is who they are after with others still trapped in the building as he was looking for additional people to attack.

 

So they should have been outside doing some survey getting floor plans or something? Was this active shooter, the guy with a deadly weapon in his hand who had already beaten people with it who was searching for additional victims going to wait until the police were ready and then continue?

You are not supposed to rely on a report of an active shooter.

 

again, THAT was the circumstance in which they believe they were entering and their ROE was to that level.

Yes they are especially with multiple calls and victims exiting the building as they enter.

Guns at the ready............OF COURSE they have to assume he will fire at them at first notice.

So about this survey you are claiming they should have waited to complete before entering the building and confronting the active shooter................please elaborate on it, how were they supposed to do it, at what point would they say OK we can go in now? How long?

Tell you what pal, I'll get a bike chain, wrap it around my fist and smash it into your temple with all my might? Ok? And then you can tell me how a police officer had just stood there letting that happen felt? If you're not dead or brain-damaged of course?

This officer acted correctly, this poor kid was killed by a million to one ricochet, if the suspect had a gun the exact same thing would have happened. It's a tragedy and no excuse for hypocrites to persecute this poor heroic officer

The police believe the gun he was reported to have already used. Can you quote the 9/11 call saying he only had a bike chain? Can you quote the 9/11 call that assured the police he was not injurying anyone and was really just a shopper looking for something to buy?

BTW a bike lock on the end of a chain being used to injury people is a deadly weapon.
