    The judge dealt with this issue in paragraph 226 of her judgment.

    We are seeing it happen right now with the Scotus leading the way supported by the Senate. Sheldon Whitehouse perseveres nevertheless to raise the alarm, almost a lone voice it seems to me. The US's reaction to DFT and his buddy Moscow Mitch is quite sad. Most certainly dear Ronnie is rolling in his grave seeing Rs failure to support the Ukraine against Russia. Who would have ever predicted this? Dick Cheney? Donnie Rumsfeld? W? And now DFT's flock considers these guys RINOs, hahaha, oh man, it is theater of the absurd.

    Surely you can put this together. You have a liberal court taking a politician off a Presidential ballot and using a politically charged congressional investigation as evidence. The same politician has been investigated for over 3 years since and no one in the DOJ has charged him for what this court is claiming. Real dictators and Fascist do this in 3rd world countries annually. We literally sanction countries when their dictators use their justice system to keep innocent people from challenging them. This isn't difficult and will be struck down 9-0. The sad part to me are the ones cheering this attempt at election interference and destruction of our democracy. There is no excuse and call it like it is for once.

    OK we're finally on the same page as far as what the Luttig theory means, and yes, if this were to actually hold water, it does make it easier to get Trump. But as I noted, it also makes it easier to get every other President. The price for taking Trump off the ballot is removing every single President in office for the rest of American history...however long it lasts.

    I agree it will be struck down, but closer to 7-2. Although I'm usually pessimistic about these things so I would not be too surprised by 5-4.

    By taking people off the ballot because they know they will lose and they know that the courts are their last option. They obviously don’t believe in democracy or they would allow democracy to play out.

    I thought the slaughter of the innocents at the abortion mills would have ranked higher.

    How about the millions of illegal aliens pouring across our southern border?

    How about the drug and alcohol addiction in this country?

    Homelessness, where almost half are children, in one of the richest nations in the world should have some consideration.

    Doesn't the incivility and crime against our merchants and neighbors deserve a look?

    The political landscape may have this country on the cusp of another civil war.

    Due process is not destructive to democracy. In fact, it affirms it. It is mandatory. Taking an Insurrectionist off the ballot is totally in support of the Constitution. Prosecuting people for criminal acts is required by our system of justice. In fact, the Orange Stain is being afforded every aspect of due process available. What is destructive to democracy is when those who think they are privileged claim immunity from due process. An election result does not erase a felony. The Orange Stain needs to answer for 91 felony counts BEFORE the election. If acquitted, he is free to stand for election to whatever office for which he chooses to run.

    Yes, a “liberal court” using the constitution of the United States. You act like they made this stufff up out of whole cloth. Then you leave out that conviction of “insurrection” is not part of the clause in the constitution.“Real dictators and fascists” use the constitution ?

    The next time someone uses the 2nd amendment as “shall not be infringed”, they are literally using the verbiage of that same document that you now claim “participates in” is ambiguous and cannot be used

    What everyone else knows is 3 of those 7 Judges refused to support it based on the fact that you need a conviction to enforce it and the SCOTUS was also approached about taking Trump off the ballot last October and they declined to even hear it because their claim isn't reflected in the Constitution.

    Know they will loose ? Trump lost Colorado by 5 points in 2016, and he lost it by 15 points in 2020. Trump got ZERO Electoral College votes in 2020 in Colorado. Biden currently has an 11 point lead in the polls in Colorado.

    MAYBE…MEYBE we should let the legal system play out here. You know, that system that uses the constitution you wrap yourself in when we talk about guns….

    I’m confident that in deliberations of the 14th no one suggested that it should be so easy to accuse of participating in an insurrection that someone who called for a peaceful protest could be branded an insurrectionist. This isn’t a justice system. This is a smear of democracy by democrats.

    He called for a peaceful protest. The violence wasn’t on him to begin with. Should Lori lightfoot have called for peace after her comments on taking up arms? Was she an insurrectionist?
