11 County Sheriffs in WA state unite in REBELLION against new gun control.

Centralized authority? We dont need it. We have a sherriff!

 

Right. So the law passed in that state is constitutional until scotus says otherwuse....not some hick sherriff

 

A sheriff is an elected official, who, if he disagrees with the Constitutionality of a law, believes that laws that violate the principles of the Constitution and follows his conscience and honor rather than invoking a Nuremberg defense and inflicting harm on the constituents under his jurisdiction, decides not to do what he considers immoral is in opposition to those that passed what he considers unconstitutional, so, what is the recourse? He’s the elected authority that they rely on to enforce their law, what are they going to do?
Then, if the Supreme Court decides against the law, what is ‘the People’s’ recourse to those politicians that passed a law in violation of the Constitution?

 

Wow, I cannot believe you lack that much of an education of the basics of law enforcement.

If a law is un-forcible, by being contrary of the constitution, a Sheriff has the legal authority to instruct his Deputies to not enforce, that law.

Broward County Sherriff Scot Israel, used this same authority, as a Sherriff, to do just that not, not to enforce laws.

But somewhere up near Margate, Florida there was a child who obtained a firearm, and was stupid with it and by the laws that the BSO did not enforce,he created the Parkland incident.

 

So the sheriff decides what is constitutional. Correct?

 

And he will decide on if it is constitutional based on his e tensive knowledge of constitutional law and legal precedent.

And, you assume he has no knowledge of the Constitution but those that passed the laws do? Really?
I like many others her have taken oaths to defend the Constitution. I have a pretty good working understanding not only of the Constitution, but of legal precedent and, in conscience, follow what I believe to be the right interpretation as I understand it; it’s why I have never advocated you or many others be silenced in this forum.

As I and others have maintained, the Constitutional fitness of a law is not dependent upon a SCOTUS ruling; if a law is ruled Unconstitutional, it, and any action resulting from its passing is nullified completely. That you disagree does not stop the sheriff from his opinion nor his dedication to enforce or not enforce what he believes is unconstitutional. So,now what?

In 50+ counties in Colorado, it means that you won't get arrested for a private transfer between friends and you can still buy "magazine repair kits" in the gun shops.

 

you mentioned constitutional, for which the new law is not... so these sherriffs are actually upholding the constitution, while the 60% & state politicians, seemed to ignore...

Yep...laws without enforcement aren’t laws. Reminds me of many stupid, unenforced laws that still exist and remain on the books because the are never enforced.

I started a thread with additional information about the sheriffs and people's reactions to what they said.

 

Well, we will see if that happens to any degree or if those among the state patrol excersise their individual discretion ... who would tell?
Regardless as per the OP, many Sheriffs are emboldening each other to send a message to lawmakers. The rebellion is growing and I ask the same as I did before. Now what?
Some time ago when certain unnamed posters suggested if the feds passed for gun confiscation that people would ultimately comply and that LE would do their duty I suggested that the assumption that LE would just go along and enforce confiscation was not a given. What is being demonstrated is a small measure of that assumption.

Not when the will of the people is in conflict with the clear meaning and intent of the Constitution.

Sheriffs (and all LEO's) take an oath to the Constitution. Many take that oath seriously, and adhere to it as their conscience advises them to. I applaud those brave people who don't let political winds shake their resolve.

 

I oppose sheriff's being pressured to enforce laws they know are unconstitutional, in violation of their oaths to the Constitution.
