http://www.msnbc.com/msnbc/6th-circuit-upholds-same-sex-marriage-bans No surprise here. I'm actually glad about this. Now SCOTUS will finally rule on the issue, once and for all striking down these bans.
Here is the full decision, starting on page 17. http://sblog.s3.amazonaws.com/wp-content/uploads/2014/11/6th-CA-marriage-ruling-11-6-14.pdf What I find amazing about the decision is that Judge Sutton talks about letting the democratic process work out while completely ignoring the fact that the judicial branch is meant to act as a check on the democratic process. They then cited the one-line summary decision of Baker, and that was about it. They dismissed U.S. v. Windsor, Lawrence v. Texas, and Romer v. Evans as irrelevant. The Dissent is on page 53. It opens with this gem: Yup. My thoughts exactly. At least one judge on that court had some sense. The sixth circuit is also way out of line, and has been for some time. Decisions issued by the Sixth Circuit were reversed by the United States Supreme Court 24 out of the 25 times they were reviewed in the five annual terms starting in October 2008 and ending in June 2013 — a higher frequency than any other federal appellate court during that time period.
