The summit of the African Ministers of Foreign Affairs or the Executive Council of the African Union is scheduled on 14th of December 2013. The summit will focus on one item in the African agenda against the ICC.

The African ministers must answer the question; what is the next step after the refusal of the UN Security Council for the African proposal on the issue of the ICC. The proposal demanded legal one – year postponement for ICC procedures against African Presidents.

The African solidarity is getting stronger but the ICC will not stop its campaign to break the African Solidarity.

The ICC prosecutor Fatou Bensouda accused the UN Security Council of prolonging the conflict in Sudan - Darfur by its failure to arrest the President Omar al-Bashir and others accused of war crimes. She selected her target in foxy way; the Sudanese President not the Kenyan President! According to the latest news Fatou Bensouda said: "This councils silence even when notified of clear failures and/or violations by UN member states of their obligations to comply with this councils resolutions only serves to add insult to the plight of Darfurs victims, Al-Bashir have been able to travel to various countries without fear of arrest.

It is a serious indictment on this council and on parties to the Rome statute that established the worlds permanent war crimes tribunal that al-Bashir and Defense Minister Abdel Raheem Muhammad Hussein, also wanted for alleged war crimes and crimes against humanity", these is the statements that made by Mrs. Fatou Bensouda.

The Security Council referred the conflict that started in Darfur in 2003 to the ICC in 2005 but since then, Sudan and specifically the President Omar al-Bashir refused repeatedly to cooperate with the ICC, the African countries have chosen the same way in the last extraordinary summit in October 2013 in Addis Ababa.

There were several offers for al-Bashir to have a deal with the western countries on the issue of the ICC. There was an opportunity to lobby the media to do something to finish the game by having a deal on the cases of Kaushib and Ahmad Haroun but he refused.

Africa now has chosen the Sudanese way, this is the problem that made Bensouda focusing on Sudan not any other country.

Until Bashir is arrested then it would appear the Kenyan ministers have nothing to fear..
