Last night Ryan said that the abortion question should be decided by the legislature rather than unelected judges. This echos what Obama said earlier in his term about Obamacare. Are unelected judges a problem? Should the SCOTUS be comprised of elected officials? I personally think electing judges is the stupidest idea imaginable. States that elect their Supreme Court members are (*)(*)(*)(*) holes. Note: A difference between Obama's comment and Ryan's is that Obama was likely referring to the political question doctrine. That is, SCOTUS should not interfere in politics when no substantive constitutional rights are at stake. Ryan on the other hand is not a trained attorney and was probably just saying that SCOTUS shouldn't have any binding authority.
yeah those evil unelected judges with decades of experience in law making rulings on the law how dare they thats like letting doctors practice medicine
The whole system of checks and balances has been disrupted by certain amendments to the Constitution that allow us to directly elect the President and the Senate. The President was originally appointed by Congress, but now that he is directly elected, Congress lost a significant check on the Executive Branch. Making judges directly electable almost completely wipes out the President's checks on the Judicial Branch, so I'd have to say no to that. We must preserve the system of checks and balances. No good can come from dismantling it.
