1. The speech is “directed to inciting or producing imminent lawless action,” AND
2. The speech is “likely to incite or produce such action.”

I would say Trump failed that test.

The biggest *LOSER* planned the event to COINCIDE with the electoral count and the MESSAGE from all of the other speakers was clearly INCITEMENT driven. They loaded his Domestic Terrorist supporters with anger and all he had to do was point them at the Capitol target and pull the trigger which he did.

As does intent. I would say Trumps intent was very clear. And the evidence is very strongly bolstered by his unwillingness to tell the "Mistaken" mob, that this was not what he meant and to leave.

His UNWILLINGNESS to call off his Domestic Terrorist Supporters once it was clearly shown that they were in VIOLATION of the law is an irrefutable confirmation of his INTENTION to incite the insurrection attempt.

Trump lied to the crowd and encouraged them to encourage Pence to break the law (he said "fraudulent elections" allowed "different rules."). That speech led to an imminent violent attack on the Capitol.

Irrelevant. Both statements may be true. The speech being the "cover" by inciting the crowd to provide, which in turn provided the cover for a planned attack on the Capitol.

If they harmed anyone or even if they just damaged property then they should pay a price but sending them to prison for INSURRECTION is so far out of line that all Americans should find it to be detestable. Far from that, half are cheering for it. Meanwhile, billions in damage and 50+ dead over the summer of love and very few of those were even arrested. Of those who were, the DA or AG in WA, OR, and Cali refused to prosecute. You folks seem to believe that such double standards are justified and will not be questioned. You'd be wrong about that. Hell, even kindergartners understand basic fairness and the Left has gotten away with things for so long that they think it's their damned birthright.

He called for them to be peaceful in their rioting, but despite the fact there had already been extreme violence he refused to call them off.

And he 'Unequivocally condemned' the rioters after the impeachment vote.
In other words he did what he's best at, threw people who supported him under the bus to save himself.
It would be interesting to see a list of the people who were Trumps inner circle who got thrown to the wolves to save Trump.
