    Heller stated that a total prohibition on an entire class of firearms, especially those that are in common use, would never pass constitutional muster under any level of scrutiny. Considering just how many millions of firearms such as the AR-15 are privately owned, they are no doubt in common use. If common use is read as to mean anything that is currently available on the legal market, the federal government cannot restrict the legal ownership of any firearms whatsoever.

    Prove otherwise.

    There is no evidence that Heller allows the federal government to restrict the legal ownership of firearms that are in common use.

    Such is not evidence that it actually possesses the legal authority to do such. Governments do a great many things they do not possess the legal authority to engage in. Case in point, the air force failing to forward the disqualifying data on the Texas church shooter to the FBI so that it may be entered into the NICS database. The air force did not possess legal authority to withhold such data from the proper authorities.
