California Magazine Limits

    Since a federal judge ruled California's ban on magazine sizes is unconstitutional, oppressed Californians have had an opportunity to exercise their second amendment rights and stock up on the previously banned magazines.

    Yesterday, the judge in the case was persuaded by the Attorney General to put a limit on enforcement of his decision so, as of today (April 5, 2019) at 5 PM, enforcement of California law restricting the freedoms of law abiding California citizens will be re-established until some future date when the case is adjudicated on appeal.

    Judge Benitez' decision was so lucid and detailed, it is hard to imagine that any court except the 9th circuit can find reason to overturn it. However, in the interim, after 5 PM today, California citizens rights will be once again inhibited by tyrannical government action. I understand all orders placed before that time will be legal.

    I am staying off the usual websites like Palmetto State Armory, GunMagWarehouse, Brownells, Midway USA, Sportsman's Guide, and others so the suffering Californians will have a chance to exercise their rights and buy many, many, many magazines. PSA has a deal on 100 Magpul PMags for $959 and I would have bought it for sure if I didn't live in a free state where all of my constitutional rights are still protected as a citizen.

    Good shopping, Californians.!!!! But HURRRRYY.

    Well the ninth circuit is about to flip after the next two Trump nominations pass.

    The State is just going to come after later with another court case. Just look at what the AG is doing right now. Obviously, the entire case was predicated on a false representation to the court and should have been thrown out on that basis alone - but this is California and common sense jurisprudence often fails here. There has never been a rational basis for the arbitrary declaration of what "High Capacity Magazine" means. There has also never been a rational basis for any declaration that "10 Rounds" was somehow "more save" than "11 Rounds" or "30 Rounds." We do really dumb things here in California, with respect to our gun laws and this is just one in a very long line stretching back several decades here.


    They don't call it the "9th Circus" for no good reason. It is the must unbalanced lower court in the system as far as I am concerned and the Forest Gump Rule applies to anything case that comes before them: "You never know what ya gonna get." You could call it the "Box of Chocolates Court." Same thing.


    They are just going to get Re-Banned anyway back down to 10 rounds. Given that my HD system involves two different mag sizes and multiple custom kydex mag carriers, quick don tactical belt and NIJ L4 armor, I would have to get all new mag carriers to support the larger capacity and then be forced to give that up and change it back once our Legislature screws us again down the road. So, I'll be sticking with my current rapid response system. But, it is tempting. ;)

    Illegal upon re-entry into California. The moment you come back across State line you are a Felon if in possession.

    In addition, that whole ammunition run to Cabella's in Nevada, is pretty much yesterday's news given the new ammunition laws which require your new ammo purchases to be registered with the State. It sucks here on respect for the Second Amendment, because the State Government could care less about the United States Constitution here. They just don't care.

    And like they found out in Connecticut, New Jersey, and California subsequent to Roberti-Roos, there will be a whole LOT of noncompliance.

    Disarmament of citizens is the first step to the boxcars to the gulags.

    They can re-ban them if they want, but by that time tens of thousands will have disappeared into the hands of citizens all over the state. And given evidence of rates of compliance with laws in other states where the oppressors have passed them, they won't be turned in to the government. Or, maybe, someone will turn in 4 but find they have "lost" the other 75.
