China the kingpin of intellectual property theft is now ramping up its demand that foreign manufacturers operating in China share their technology, and infrastructure with Chinese companies, because not doing so constitutes monopolization. If interpreted broadly, companies could be forced to license their intellectual property (IP) to Chinese competitors or lower licensing costs to benefit local firms, at a time when China is seeking to promote domestic champions. Draft guidelines for implementing the country's 2008 Anti-Monopoly Law put forward by two of the country's antitrust regulators go beyond global standards, experts and lawyers say. Telecommunications, pharmaceuticals and renewable energy industries, all priority areas for Beijing, are likely to be the most vulnerable. How sad, frustrating and bogus that China, an IP taker, not an IP creator, cannot 'make it' by herself, and therefore is demanding that trade secrets be given away to Chinese competitors. First they steal everyones IP, and now they openly demand that IP secrets be shared with Chinese manufactures or face fines up to at least a billion dollars. Trade lawyers in the US are more than a little nervous about this new development.
