    It's 2nd degree murder.
He will be convicted of manslaughter though.

We will have to see how a jury deals with it , but in my state a felony flee and run can be stopped with lethal action... don't know the laws where this guy was and how they dealt with his actions.

Innocent? I don't know. I'm very pro law enforcement, but I won't sit here and defend this from what I see at this point. Officers are issued radios for a reason.

I wouldn't have any idea. Only way I would know is to ask him and he's dead. Now, why do you suppose the cops felt the need to lie about what happened?

Training. Higher education standards. Rigorous mental stress testing. I can't imagine why he thought he needed to shoot. He had to lie because he knew he was wrong. I hope the other cop is charged for trying to cover for him.

My guess is that they lied because the officer expected his actions to be met with a murder charge if they told the truth. Guess he hoped they cover for him and destroy the video and never mention it.

you seriously think the military would be better at policing america????

the military does not go through training on how to deal with the public, they go through training on how to achieve superiority in any situation through overwhelming force... that is dramatically different in how this would have occurred if the military had approached this vehicle...

if the military stopped this vehicle they very well might have shot it, before they even bothered to indicate they wanted the person to "pull over"... if the military had gotten out it would have been guns drawn and pointing and screaming commands at the person, which if not instantly complied with would have resulted in lethal force being the FIRST option, not a discussion with the person... if the military had been involved in this, they would have emptied their guns into that vehicle as it moved away from them...

do NOT try to make such bold outrageous claims about what the military would have done in this scenario...

you sir, are wildly out of touch with reality...

police are trained to do exactly what this officer did... you know why... because THEY have every legal right not to be harmed in the line of duty... and they are trained when people physical begin to resist to apply force to stop the resistance so THEY don't get harmed or killed... have you ever watched some of the videos in police training showing just how quickly an officer can die in an instant if they don't take an aggressive stance... believe me, THEY are made to watch those videos... because it saves their life quite often by having those methods of response...

split second decisions are SUPER EASY to judge after the fact with all the evidence... but a SPLIT SECOND decision is not easy to make in less than a second...

I keep seeing you and other say the cop lied... where did the cop lie... have you ever remembered an event that was caught on camera, and not had a slightly different view of what happened?

the statement people seem to be showing as "proof" he lied and executed this guy, is that the cop said he was being dragged by the vehicle... well the vehicle did in fact begin to move, he was in a struggle, and he did lose his balance and fall to the ground (either as a result of the vehicle moving, shooting his weapon, or simply being off balance when physically in a confrontation with the man)... and then we see the vehicle speed off... so wouldn't it stand to reason, the officer remembers being "dragged" (however little we may have seen) because in his mind the vehicle went off flying and he fell to the ground as the same time that occurred... a reasonable person who was just in a highly amped situation very well might remember that was being dragged by the car...

so is that the only proof people have? proof that can be reasonable explained and justified since all the motions involved can be demonstrated and shown to be relatively accurate? have you ever written a word for word report after an incident, and possibly gotten some things out of order, they all occurred, but you remember a different flow of events despite all your words being true?

I don't see any other facts being disputed by folks, so if you have other things by all means add some detail to what it is to help further the thread along... because my presumptions don't really help move it along unless we're really talking about specific things in detail...

You're trying really hard here. Why is it so important to you to minimize this officer's crime? He a family member or something? He most definitely lied.

the cop could not easily be hit by the vehicle, now maybe if he was standing in front of it when he started the engine.. then you would have a valid point

I'm not trying to minimize what occurred... I'm trying to objective and not rule out facts because of my personal feelings or thoughts... I'm reviewing all the information and trying to see if its unreasonable to say he truly felt he was being dragged...

notice how the district attorney charging him says "its my belief he was not dragged"... BELIEF and FACT are vastly different things... so even the district attorney is being VERY careful in what words he is using to describe this incident... if he had come out and said "we've proven through this video evidence he was not dragged" then you have a total whopper of a story and I couldn't dispute a single fact you or others say... because its be a fact...

but its not... you're using personal feelings and a very narrow scope of what you consider being dragged to mean... if that car moved in ANY way, he was being dragged since he was physically trying to restrain the person and the person had one hand on the officer trying to get him off... and another hand turning the car on which was deemed to be a fact now, and who knows what happened after the car turned on with that other hand...

so what we 100% can prove, there was a physical resistance from the door being pulled back shut, and the officers arm being grabbed after he reached in the vehicle, then we can prove the car ignition was turned on, then we can see both in combat with each other while the officer was drawing his weapon with his free arm... this is where it gets fuzzy... did the car move first, or did the officer fire first... from the current video we can't prove either... (the big question we should have is was there a dashcam in the officers car showing this entire event)

but why is it so impossible for you to believe, the car moved, and the second it moved, he shot him at that split second? the car clearly was turned on, the car cleared went forward so it was put in gear, and the officer clearly ended up on the ground...

and the new video from the OTHER officers dashcam shows the officer out in the middle of the roadway on the ground... it all seems to jive together to make a reasonable conclusion he in fact was dragged, albeit not 20-30 feet, but the mere fact that car was NOT running, and had to be turned on, and put in gear, gives me dramatic evidence to suggest it did move or was about to move while the officer was in a struggle with the person... that car moving an inch would be all I need to justify that shooting...

why are you so quick to dismiss all this? to steal your line, are you a family member of the "victim"... he most definitely was violent... all his actions prove it...

Not having a front license plate is not an indication of a murderer on the loose. Nonsense. Maybe we should go full fascist and put everyone through a checkpoint every half-mile or so, you know, to catch any possible wanted murderers.

If we don't fight for our rights, we will lose them. I'm amazed at how many people are willing to hand their rights over to fascists with a gun.

I'm one who has supported the police over the perpetrator in a lot of the recent situations that have been on the news. A lot of them, but not all, and this one is definitely not one I support.

A police officer fired a weapon at an unarmed man who was not endangering others and who was not assaulting the officer. He pulled out his gun and became judge, jury, and executioner all on his own. And then he lied about it.

He should be convicted of homicide and sent to jail.

Yes, the military is trained to show incredible restraint in hostile areas. The cops here are incredibly fidgety and are killing way too many civilians.

I can judge because I saw the video. The cop put himself in danger by reaching in the car while the guys arms was out. And while people believe that cops have a right to go harm unharmed, that is fine. However, there is way too much interaction between the police and the civilian population. So much so, people are getting their face blown off over some GD tags.

are you kidding I am one of the people who will argue with cops when they have no legal right to do something, so believe me I am against checkpoints (especially the border checkpoints 70 miles inland) and all unlawful actions...

but I'm pointing out a fact, when officers keep letting criminals get away with things, we have exactly whats happening across america right now, an absolute insane uprising in crime across this country because cops don't want to get accused of being racist or aggressive anymore... so they are letting people get away with a lot of petty things that are turning into larger things after the fact and we realize they had someone who should have been taken into custody but they didn't want to press the issue and turn it into a big event...

I'm all for fighting for rights, but I'm not for yanking car doors shut, and physically grabbing a cops arm, or turning on a vehicle, or having it in drive, and pulling away from a cop...

the guy knew he was going to be arrested for some say the 30th or 40th time... and he did everything a criminal does... which is deceive and lie knowing he didn't have a license, he hadn't had one for over a decade... he then turned it physical putting himself and the officer in danger...

and guess what... the criminal lost the battle of the "wits"...

I'm all for suing cops and making cities pay millions when they screw up and violate the rights of people... but at no point were this guys rights violated "for a simple front license plate, no big deal, let him go"... this guy resisted, obstructed, and ultimately assaulted an officer by putting hands on him and putting that car in drive to potentially flee the scene... there was NO violation of rights here... there was simply a criminal who was too stupid to keep it a misdemeanor, and he escalated it to a felony, and then paid for it with his life... ALL... HIS.... CHOICE....

he didn't get his face blown off for "tags"... he got his face blown off for lying and deceiving the cop when the guy hadn't had a drivers license in a decade... he got his face blown off for physically resisting and assaulting the cop who at this point gave him a lawful order... he got his face blown off for turning the ignition ON and putting the car in drive to get away from the officer after resisting and assaulting him...

at what point do we let cops be cops...

99% of ALL police interactions are non-violent... 1% are violent... 95% of ALL traffic stops result in nothing more than a ticket for the offense they got pulled over for, only 5% turn into something else like additional tickets or an arrest...

those are not the stats of an overly aggressive police force in america... those are the stats of something going right in america...

P.S. since you watched the video did you not notice ALL those actions the "victim" did... or are you dismissing those actions as normal behavior???

Well this "cop" was a University campus cop.....I never understood why they have guns to begin with. But I do not believe the cop had any malice. It seems he panicked. That doesn't make the driver any less dead though and I believe the justice system will work well.

The officer stuck his gun in the car and shot him before he could get away. How is that not murder?
