Where did you learn that Employers are allowed to make a rule stating that employees can not drink alcohol or smoke cigarettes - or mess with the essential liberty of that person in any other way - on their own time on their own property ?

What a nonsensical question given the context of the conversation. You do not even bother to distinguish between at work and not at work which is beyond pathetic.

I've explained this. When they come up with a test that can determine if someone is currently high, this issue goes away. Until then, it is what it is.

For many industries, it is a liability issue.

Why are you so hell bent on telling others how they feel? It's childish.

There are constraints, and the Constitution restricts the power of the government.

For example: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

However, it does not say what your neighbor can say to you, or what your corporate your employer can enforce.

You and your liberal gestapo insist the government can insert itself into the issue, and tell corporations who to hire and not hire/fire.

There is no law dictating what their corporate policies should look like, so they are free to create their own policies.

How many times do things need to be repeated to you?

You have not explained anything. All you have done is avoid the essential liberty question. If there is no test to determine if someone is currently high - they should not be administering the test - Period - as that is all they should be allowed to assess.

The liability issue has zero to do with whether invading someones privacy is Legal or not.

Further - there are tests that can determine whether or not someone is high on the job and all that would be required is to forbid the testing company from releasing information relating to THC levels lower than what would be classified as High on the Job.

You are the gestopo. You are the one that wants an employer to be able to mess with the civil liberties of the employee outside of work.

People are not allowed to infringe on the essential liberty of others. You are not allowed to arbitrarily detain someone - and engage in arbitrary search and seizure .. and nor does you owning a business allow you to arbitrarily detain your employees and engage in arbitrary search and seizure when that employee is not at work.

Nor are you able to coerce your employees into following your religion when not at work (or at work for that matter).

You have a completely discombobulated understanding of the Constitution and the founding principles.

There are laws that relate to corporate policies. What you are saying is an absolute falsehood. A corporation can not make policy that violates a persons essential liberty (except in extreme circumstances). A corporation can not use slave labor (in the US), a corporation can not make a policy that allows for it to come into your house and engage in arbitrary detainment search and seizure.

What a bunch of clueless nonsense.

    You angry?

Corporations can, and routinely do, make policies to drug test their employees. It is legal, and I am sorry if you and your liberal gestapo have such a problem with it. I suggest you find a company who do not test their employees.

Come into your house and search and seize? What on earth are you talking about?

Heck, for a while the State of Florida drug tested everyone on welfare. It was legal, and ended only because it was costing too much money.

BTW, Did you know the Supreme Court has already ruled that it is legal for employers to conduct drug tests?

Some States have created laws to protect medical pot users from termination, but none have done so to protect recreational users, so until they do, you'll just have to suck it up.

Please cite the law that says employers cannot drug test.

Do you walk to work or take your lunch ... Please cite a law that states the moon is not made of green cheese.

    What a stupid question.

Your claim is, "A corporation can not make policy that violates a persons essential liberty (except in extreme circumstances.)"

Which law says that smoking pot is an essential liberty and your employer can't test for it?

I was surprised that they stopped it, even when they figured out that most people on welfare, don't use drugs. Since all that gravy was flowing to Scott's wife's medical testing company, I thought it was here to stay. The senator now has a plethora of opportunities to score the sweet, sweet cash from lobbyists and such. What a scumbag. I'm digging our new governor, so far. We'll see how it goes.

Nobody paid 90% of their income. That isn't how income tax works. And yes % revenue to GDP has bern about constant however the distribution about who is paying what has changed thanks in part to the reduction in Capital gains tax, estate exemptions, lowering top rates , lowering corprate rates and endless changes designed to help the rich.

There is a reason that more and more of the total wealth has accumulated at the top. It is the Republican goal. It is class warfare, butbthe rich are winning.

What did I say that made you think I needed a lecture that re-explains what I just said?

You need to go learn what an essential liberty is. This question shows how poor your understanding is and of law in general.

    Really dumb.

Millions of people get drug tested on a regular basis. What law are their employers breaking? Be specific. I may want to call the cops.

I am not denying essential liberty to employers. What essential liberty is being denied ?

You on the other hand want to give employers the power to violate essential liberty = Privacy, Arbitrary search and seizure and so on .

It wasn't a priority at the time; instead they were focusing on getting Obamacare passed, which they did.

I never claimed a law is being broken ? You keep coming up with really absurd statements and bad arguments ... such as:

    1) The question being addressed, in case you have not noticed, is whether or not essential liberty is being violated illegitimately. Many laws violate essential liberty. The inferred claim you are making is that because something is law essential liberty is not violated.

I do not think you actually believe this - I could be wrong. If you don't believe this then your question is absurd nonsense.

    2) Your statement "they can just not apply or go find another Job" is equally absurd. You are claiming .. as Pro-Line did - that there should be no restrictions on what an employer can do - either with respect to hiring or with respect to firing an employee.

Do you actually agree with your own claim ? Should an employer be able to discriminate on the basis of color, gender and so on without limit ? Should an employer be able to threaten an employees job should an employee refuse to have sex with the boss ?

Again I do not think you actually believe this - I could be wrong - If you do not believe this then your argument is absurd.
