Family farm banned from city farmers market over refusal to host gay weddings

    Their 'discrimination' has nothing to do with their activities in the park! It's an entirely separate activity and location - and that location is PRIVATE PROPERTY.

    I just don't see any legal way in which your comments here make any sense at all.

    The wedding business is one business. It discriminates in all its activities.

    I have no idea what you're trying to say here. Private property laws apply to lease holders as well as owners.

    ONLY CLUBS/CHURCHES etc are subject to accommodation laws .. the vast majority of private enterprise is NOT subject to those laws. Just stop it .. we're not talking about damned clubs, guy!

    Unless the business discriminates by not selling their strawberries to gays IN THAT CITY PARK, the city has zero legal footing to exclude them. What these people do on their private property is none of the City's business.

    All businesses in the US are subject to anti-discrimination law. Private property is irrelevant.

    If they are a business, then they have to follow business law.

    If their business is to sell wedding services, then they have to sell wedding services, even to individuals they hate.

    Discrimination is NOT illegal, only declaring a discriminatory reason for that discrimination is. If you struggle with the minutia of laws, best not to discuss them in depth.

    You absolutely don't get it .. at ALL.

    Private enterprises (all business which are not 'clubs or churches'), are legally regarded as private properties. They have exactly the same protections and rights as you have in your own home. They are no more legally obliged to allow anyone in, or to serve them, than you are obliged to allow anyone in to your home just because they asked.

    That didn't answer the issue.

    You didn't add the caveat that to buy those strawberries at the park, you had to meet with the KKK an get a certification of whiteness in order to take part in the strawberry sale.

    The wedding business is one business. Partaking in the park wedding was disallowed by the business for reasons that are not acceptable for a public accommodation business to require.

    Nobody in the park could ask the officiant to marry them, too. Everyone wanting to be married had to go through the business and pass their discrimination.

    No, this is just not true at all. It's just absolutely false.

    I can be as much of a bigot as I want in my own home. I can let in or exclude anyone I want. Period. No questions asked. If I'm in Florida, apparently I can shoot people off my porch if they seem "scary".

    BUT, in my business, I have to follow the laws that apply to my business. That includes employment law, for just one example.

    And, if my business is a public accommodation business, then I have to follow public accommodation business law.

    Clearly, you have ZERO personal business experience.

    You missed the crucial point, entirely.

    Discrimination is not illegal, only a DECLARATION of discriminatory reasoning is illegal. Please try to absorb the very crucial difference. You can discriminate your pants off if you want - as long as you don't declare it to your 'victims', it's entirely legal.

    They sold their produce at the farmer's market (city property). They weren't hosting weddings there.

    Look, you're horribly out of your depth on the laws .. or you can't grasp what PRIVATE PROPERTY means.

    Let me try to explain it again, as simply as possible:

    PRIVATE enterprise (when not a club etc and thus not subject to accommodation laws) has exactly the same rights and protections as the resident of a private property - because it IS private property.

    Both the private enterprise owner/lease holder, and the private residence owner/leaseholder, are legally entitled to refuse entry/service to anyone, at any time, for any reason.

    You need to make peace with that reality, no matter how much it upsets you. It's the LAW.

    You have no clue how US law works, crank. All licensed businesses are subject to anti-discrimination law. It doesn't matter whether the investment of private property includes a 40 acre ranch or a laptop and a couch, all licensed US businesses are subject to anti-discrimination law. It's really that simple.

    the city enforcing consequences it shouldn't be constitutional you have the right to do just about whatever you want on your private property. Forbidding people from commerce because they hold opinions and viewpoints that you don't like is abuse of power.
    those two things don't have to do with each other. Banning them from the farmers market is simply punishment for wrong think. Fabricating consequences to force people to agree with you is an abuse of power.
    it absolutely isn't. That's the city using its power to enforce artificial consequences.

    If the consequences of this was people simply didn't buy their produce at the farmers market that would be natural but to ban them for something they do completely outside of the farmers market is not even related.

    It would be no different than Banning Muslims for doing the same thing.
    if that was the case the city wouldn't need to ban them. I think the fact that people don't care about this and would buy stuff from them anyway is the problem which is why the city would ban them.

    Why not take away their driver's license for their ability to use public roads? Why not shut off the water why aren't these consequences people have to pay for wrong think? If the city controls the streets who gets a license and the municipal water or even electricity why can't they do that why is it only okay to ban them from a farmer's market because of something completely unrelated?

    OK. I thought someone posting here indicated that at least some of the weddings were at the park. I should have read the whole darn thing in detail.

    Anyway, the city is treating them as one business.

    One of their products is weddings.

    That business clearly states that it discriminates.

    If the KKK wanted to sell produce in that park, I would find it both surprising and objectionable if the city were to allow that.

    Clearly, the farm in question and the KKK do not follow public accommodation law in their businesses.

    Why can't they cut off their water or take away their driver's license or shut off their electricity?

    If the city came withdraw services selectively why is it just this one service?
