It doesn't matter if Israel is a ratifying state to the convention, individuals are still allowed to file complaints with the ICC. They're called "communications" and there is no guarantee that they will be ruled on which is why the article doesn't hold high hopes for this particular case.
As a side note, this isn't the first time that such a communication has been made to the ICC. they have received communications concerning Hamas before, so I'm not sure what Borat is so giddy about.
