Indonesia's Parliament votes to ban sex outside of marriage

Indonesia’s Parliament unanimously passed a long-awaited revision of the country's penal code on Tuesday that criminalizes sex outside of marriage for citizens as well as foreigners, prohibits promotion of contraception and bans defamation of the president and state institutions.

The amended code says sex outside marriage is punishable by a year in jail and cohabitation by six months, but adultery charges must be based on police reports lodged by a spouse, parents or children.

It restores a ban on insulting a sitting president or vice president, state institutions and the national ideology. Insults to a sitting president must be reported by the president and can lead to up to three years in jail.

Prior to this news, I couldn't think of a good reason to go to Indonesia in the first place (although I did visit Bali with my family as a preteen). Now there are nothing but reasons to avoid like the plague.

I won't even get into the entire insult v criticism thing. That's a hair that I don't think that can be split...

How do you even implement these laws? Citizen monitoring? Honor system?

I have been to Indonesia since the 80's and I can tell you one thing, if you SCUBA and love warm water beaches, that place is heaven on earth. They are also very relaxed in their laws and unless you really do smething wrong, you have no worries.

 

Well, this is their Parliament, probably overstepping the will of the people, as countries that rule via religion often do.... But a country like that would never have the guts to put those issues on a ballot like we sometimes do here...

Fortunately, the American conservative right hasn't set its sights on non marital sex .... yet... likely only because enforcement would be a bitch...

I think this should be in the international subforum.

However, this is Indonesia, the largest Muslim country, by population, and a top ten of ex-pat retirees because of its cheap cost of living. It will be difficult to police some of the provisions, such as "sex outside of the marriage" but not so much on the definition of the President and its government institutions.

What most people don't know is that there is a growing underground Islamic fundamental movement in Indonesia that has not reached the capital or major cities yet. And Indonesian women are not exactly like Filipinos or instant girlfriends who will sleep with their boyfriends in a heartbeat. It is a very socially conservative country, relatively speaking. So this is no surprise.

While I don't think you will find many people in America who agree with this law and do not find it blatantly absurd, let me point out that progressives will find the idea much more unimaginable than conservatives.

Indonesia does not have same-sex marriage, so gay people will be out of luck under this new law.

The law is also likely to weaken marital protections to women. When it is illegal for a man to have sex with any person other than his wife, then the society is going to see it as a necessity for the wife to provide sex to him. Or in other words the notion of "marital rape" is not going to exist. (You can't make sex in general illegal, so something somewhere is going to have to give, it's only natural and inevitable)

 

I hope you don't mind that I quoted you, as an example of this-- because I'm sure others have done the same thing, as you do here. But you are making the mistake of assuming the Indonesian legal system functions in a manner, similar to our own. My understanding-- which, granted, may be dated, since I came to it, through the re-enactment t.v. show, Locked Up Abroad-- is that, in Indonesia, when the state charges you with something, you are basically considered to be guilty. Not that I had any plans to go there, in the near future-- though it really seems like a place of great natural beauty-- but I would definitely not go there and share a room, with anyone who wasn't my wife. I think it can only be a matter of time, before some vacationer (and the favorite would probably be an American) gets arrested and imprisoned, because of this law.

Bali was on our short list for a diving trip in 2023, seeing that over a dozen people in the group would be going with an unmarried partner I can bet it will be removed from consideration pretty quickly.

 

Personally I wouldn't go back to Bali on a bet, but the laws won't impact you in 2023. They will take 3 years to implement and even then charges can only be brought if a family member reports the relationship to police. Presumably that won't happen to your group. The bigger risk is if anyone gets involved with a local.

I would still go elsewhere, even in Indonesia. Bali is basically where poorly behaved Australians go for cheap beach excursions - a bit like parts of Mexico to the US. Generally the sort of people I would travel to avoid. Plenty of nice coral in the world.
