If there is any question of eligibility related to the 2008 election it is John McCain that failed the criteria of being a natural born citizen of the United States because he wasn't born in the United States, he was born in Panama, and the 14th Amendment clearly establishes that a natural born citizen must be born in the United States.

But McCain is white so, of course, the WASP racists don't want to question his "natural born citizenship" status where he clearly became a US citizen based upon the naturalization laws passed by Congress. Instead they continue their racist attack on Obama that was born in Hawaii in 1961, where his COLB has been verified as legitimate by a non-partisan organization, that meets both of the criteria established by the 14th Amendment, exclusively because he's an African-American.

We have confirmation that Obama's COLB was authentic and that he was born in Hawaii in 1961. Additionally the Hawaii Dept of Health, which is responsible for birth records, confirmed that Obama was born in Hawaii in 1961. President Obama meets the Constitutional definition of natural born citizen enumerated in the 14th Amendment that existed from the very first day the United States was founded.

John McCain was not born in the United States but instead was born in Panama. The 14th Amendment establishes that only persons born in the United States and subject to the jurisdiction thereof are natural born citizens. If "Birthers" want to question natural born citizenship they need to be questioning the eligibility of the "white guy" that ran in 2008 because he wasn't born in the United States of America. John McCain became a US citizen based upon statutory naturalization laws passed by Congress and not because he's a natural born citizen of the United States.

So let's look at the statutory law of congress related to citizenship at birth.

Now, simply remove this law from the books and who remains? Only those identified under definition (a) because that's just a reiteration of the criteria established by the 14th Amendment to the US Constitution.

Even if the statutory law doesn't exist these individuals would still be natural born citizens of the United States because their citizenship is established "BY BIRTH" based upon the 14th Amendment as opposed to merely being granted citizenship "AT BIRTH" based upon statutory law.

Natural Born Citizenship is Established by birth and is exempt for any statutory control by Congress. It is the Right of Citizenship of the Person and the criteria for it is enumerated in the 14th Amendment. Anyone else granted citizenship "at birth" by statutory law is a "naturalized" citizen of the United States. Simply delete this law and whoever is a natural born citizen based upon the US Constitution are the only natural born citizens of the United States. "Born in the United States" and "Subject to the Jurisdiction thereof" is the Constitutional definition of natural born citizen and it is not dependent upon the congressional authority to create uniform laws of naturalization.

A person born in Canada or Panama or even Guam or Puerto Rico is not born in any of the 50 United States and is NOT a natural born citizen of the United States based upon the enumerated criteria established by the 14th Amendment. Anyone granted citizenship "at birth" under USC› Title 8 › Chapter 12 › Subchapter III › Part I › § 1401 is a naturalized citizen of the United States based upon the statutory authority of Congress to create uniform laws of naturalization under Article I Section 8.
