Former President Donald Trump's attorney said Tuesday that the former president will likely challenge the legality of the FBI's search of his home based on the Fourth Amendment…

…"In terms of what we do in the future, you know, there's this Fourth Amendment like you brought up, there's a fourth amendment issue here; the warrant was way too broad," she said, before pointing to the judge in the case as a pivotal factor.

U.S. District Judge Aileen Cannon will preside over the case in place of Magistrate Judge Bruce Reinhart, who approved the FBI's search warrant. Trump appointed Cannon to the bench in 2020 and she has already signaled she will likely grant his request to appoint a "special master" to review the documents the FBI took from Mar-a-Lago…

…"So at this point, I think the best thing we've done is we've gotten a judge in place... who does look like they're going to be active," ..

…The Fourth Amendment protects against unreasonable searches and seizures.

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized," …

    T
his is good news. The 4th amendment is huge here and it looms large in resolving these cases. Trumps 4th amendment rights were clearly violated by the present regime and its deep state apparatus.

The DOJ and FBI are politicized by the deep state and are Biden’s personal Jack booted thugs. We need a judge to enforce the constitution against them before it’s too late for the republic.

IF (Repeat IF) this "legal strategy" is pursued, it will probably be laughed out of court...
I am surprised that Trump doesn't have legal geniuses like Sid Powell and Rudy leading the charge...

And even it Florida in will probably fail. Trump is just hoping no one has ever spent more than 4 minutes thinking about the 4th Amendment. Not going to work.

No, they don't, do they.... Thanks for confirming we aren't a banana republic, refuting some GQP monkeys who claim we are...

If I had a dime for every time any MAGA poster (but especially the OP MAGA poster) posted some ridiculous legal route T**** might take on some issue in front of him, I might be able to afford a bottle of water in Jackson Mississippi right now...

BTW, where's my much ballyhooed CNN defamation lawsuit?? Been over a month now....

28 USC Section 533 authorizes the US Attorney General's Office to appoint officials to detect and prosecute crimes against the United States. Section 3107 authorizes the agency to make seizures and make search warrants in violation of federal statutes. Finally, section 3052 allows the FBI to arrest people, carry firearms, and conduct search warrants That authority is also through the ordinary and necessary clause within the Constitution. This is all under the auspices of the necessary and proper clause of the US Constitution while the Attorney General is nominated by the president and confirmed by the consent of the Senate in Article 2, specifically the appointment clause. This has been confirmed by the Supreme Court through numerous court cases beginning with United States v Hartwell. So, good luck with that

Well, she looks (slightly) better in that dress than Garland would, which is why she was hired in the first place...

The right is all about pretty faces, with or (for the most part) without brains; Lauren Bobert proves they like em "the dumber the better".

Good luck with that. Conservative judges have basically nullified the 4th amendment to make sure the people with pigmented skin don't get off on a technicality.

TRaitor tRump is mining the search of Mar-A-Lardass for all it's worth, but by keeping it in the news he's forcing the DOJ and NA to rebut his ridiculous claims. And in the process making the nature of his crimes more public.

TRaitor tRump is the only one politicizing this investigation.
