Hate crimes, like terrorism are crimes against community cities not individuals. Both are meant to terrorize a group. It is an added charge. Why do people not want to lock up terrorists?
One is more likely to set the country back then the other. One is more likely to have an intimidating factor on the community then the other.

Why should someone that killed with forethought be punished more than someone who kills spur of the moment? Intent has always determined the crime committed. I'm against hate crime laws because they are not used consistently. The theory is ok. Basically, the idea is to punish crimes based on some kind of group-based malice more, in order to stop that kind of malice.
I guess it would depend on the other crime, but a murder of passion doesnt really affect the community or society the same way. But then again, the streets that are the most intimidating in America aren't that way because of rampant hate crimes. It is is just a general lawlessness.
We use intent to differentiate between crimes: the difference between murder and manslaughter is intent. But we don't differentiate between murder out of jealousy, greed, or boredom. We only differentiate when its racial hate.
