    Given the quoted text, assuming it actually came from the linked article, then I would have to side with the state here. They are not denying this guy the right to sell private property, guns or not. They are enforcing a zoning regulations. Notwithstanding my stance that many zoning regs are wrong, or ill thought out, the use of the second amendment as an argument in this case is simply the wrong argument.

    What activist judges? This is obviously a zoning issue, not a second amendment issue. Granted, the county could and probably should, have issues an exception for being close enough to satisfy the intent of the rule, but there is no requirement to, nor does it violate the second amendment to not issue the exception.

    The city of Chicago attempted the same thing, and the federal court told them that they could not engage in such a course of action. The city was actually ordered to allow federally licensed firearm dealers and shooting ranges to be opened and operated within its territory.
