Supreme Court takes on ludicrous Obamacare birth control demands

    Seems the closer this gets to reality, the more people are finding the ludicrous details of ACA to be unacceptable.

    Private business owners are supposed to pay for their employees contraception ?!
    Since when are condoms and diaphragms considered "health care" ?


    Nearly 50 pending lawsuits have been filed in federal court from various corporations challenging the birth control coverage benefits in the "Obamacare" law championed by President Barack Obama, which has come in for fierce political criticism over its rocky public introduction.

    The high court last year narrowly upheld the key funding provision of the health care law, a blockbuster ruling affirming that most Americans would be required to purchase insurance or pay a financial penalty -- the so-called "individual mandate."

    The constitutional debate now shifts to the separate employer mandates and whether corporations themselves enjoy the same First Amendment rights as individuals.



    Companies face $1.3 million per day for not complying with these ridiculous laws embedded into ACA.
    Hobby Lobby, a large retailer in 42 states with over 13,000 employees says it will not be complying with that law.

    I can't see the USSC upholding this.

    Yes! And right they should. All health plans should pay for neutering and spaying as well.

    Birth control pills aren't just used for contraception. There are various health issues that they are prescribed for. I know this because I have two nieces who have menstrual related issues that take birth control pills. One of them was found laying on the floor of the bathroom after a shower because she was too weak to move.

    In addition, the companies aren't paying for the contraception. Whatever happened to health care should be between the doctor and the patient? That was a mantra repeated by the right-wing, right up until they decided that they wanted to declare a war on vaginas.

    This is a losing battle for a right-wing that has no idea how to gauge what real Americans think. It's also hypocritical because access to contraception, including birth control, is the most effective and realistic way to lower abortion rates.

    But nobody ever said the right-wing is consistent.

    Understood, and that is written up as a "medication" instead of "contraception" ?

    I just don't see all forms of "contraception" being a required coverage.



    Funny, the USSC sees it differently.

    I guess they should defer to you.


    Yeah, "war on women" and all that other made up BS.

    Not sure how not wanting to pay for everyone's birth control turns into a "war on vaginas" but I admit I have trouble thinking like the typical lib.

    Marihuana also has medicinal applications. Should ALL Americans be required to have marihuana covered by their health insurance?

    Let's see, we have 50 lawsuits and HUGE opposition over a provision in the ACA that would make insurance policies treat birth control equally with other medications that you have to see a doctor to get prescribed, and have numerous health implications and complications

    In the meantime, not ONE lawsuit or even thought against the fact that health insurance from all these so-called "religious employers" has covered men's boner pills like Viagra as a sort of human right from DAY ONE of their existence! How many abortions, out of wedlock pregnancies and gay sex has been made possible under their influence?

    Don't tell me there is not a "war on women". Which the men already won long ago.

    I find it fascinating that the right doesn't think contraceptives should be part of the ACA.

    I guess they haven't heard that condoms prevent the spread of venereal diseases and can drastically reduce the number of unwanted pregnancies. That birth control is used by millions of women for menstral regulation.

    Perhaps one day, the ridiculous religious right will come to grips with the fact that humans have been having pre/extra/supra/intra maritial sex for only a few hundred thousand years and that a mature, common sense approach will rapidly alleviate and contain the medical problems associated with that rather pleasurable "sin".

    Myself I think this one of the sillier complaints about the ACA, but if you work for a company that doesn't provide birth control with their health ins for religous reasons, here's an idea, get your own (*)(*)(*)(*)ing insurance. Why do you get to dictate that someone else supply something that goes against their religion to supply? And since the ACA , at least theoretically has made insurance cheaper obtaining your own shouldn't be a burden. Hell if you're that offended I'd even find a new job.

    i'll go one further and say that private businesses should not be in the business of paying for anyone's health insurance.

    I think that is one of the problems with our American health care insurance- the connection between employers and health insurance.

    It is unhealthy for businesses and for employees.

    There are numerous mind-altering drugs that are covered by health insurance. Opioids, barbiturates, morphine-based pain killers...these are all covered. If marijuana has a proven efficacy in treating a certain disorder, then why not?

    Or we could just legalize it and people could grow it in their backyards for virtually free.

    Oh please... show me some proof of this one.

    Best anyone can seem to provide is co-pay, like birth control pills have always been.

    Please show me where companies are covering Viagra without a co-pay like the pill, the shot, the implant, the ring, the diaphragm, the cervical cap, etc.


    Or was that just more whiny "war on women" BS ?

    It's fine that you think it's silly but some people have religious beliefs and happen to own a business.
    Not to mention... I find it stupid that I am paying for women to get implants, and diaphragms, etc.

    But the good news is... you and I are both covered for all breast-feeding "supplies".
    With no co-pay ;)

    It has always been great that businesses provided insurance to it's employees when they could implement plans that they could afford, and would keep employees interested. At their own will.

    With these new laws, all it is doing is forcing them to pay more for less, and pass it on to the employee.

    So I agree, private businesses should have been removed from the picture, because we have seen too many companies laying off and/or reducing hours because of the drastic, upcoming increased costs.

    Why are you bringing up "copay"? Most of these lawsuits are NOT about no "copay", they are about demanding to NOT covering birth control AT ALL in their "selectively-religious employer" company!

    These suddenly-devout Pharisees (after years of providing insurance that covered women's birth control) are NOW balking at insurance that pays ANYTHING for women's birth control! Copay or not! The mandate REQUIRES coverage, the "no copay" is only a secondary issue.

    Get with your side's propaganda program! Ya gotta keep up with the Right's "Why we hate Obama Hate-of-the-Day"!

    it's better for the individual to have to purchase their own insurance - no need to add the employer into it. what's the gain ? instead of buying insurance for the employee, the company should just pay out that amount to the employee

    "Sleeping around?" Humans have been doing exactly that since day one of our history. Might be time to acknowledge that is the case and be grown ups about mitigating as many undesirable outcomes of such consistent human behaviour, as possible.

    There is a very "free" way of doing the same thing.

    It's great that you are so happy to pay for tubal ligation so someone can have all the careless sex they want and not get pregnant, because you have absolutely no choice in the matter.

    As for me, I think those wishing to have that protection should cover it themselves.

    Then again, I tend to take responsibility for my own actions.
    I've never been a supporter of the "hand-out" mindset.
