I say that because I want this issue to go before the SC so that the issue can be settled once and for all, oh except for the whining. My guess is the SC will uphold the 14th as it is written and has been applied. Just curious, if they could over turn the 14th would it be retroactive and if so is Rubio going to be deported to Cuba?

 

As written but not as applied. why would Rubio be deported? Its all now a political football and SCOTUS has become a political entity unfit to rule on such matters. Leaving us to either agree or disagree with their findings on our own personal opinions whether they are right or wrong matters not

The Bill of Rights applies to everyone-even non-citizens, with one or two exceptions-mostly applicable to political office. Why does it take a foreigner to educate Americans on their own Constitution? I would be embarrassed, frankly.

There are 3 types of citizen. To be a regular citizen all you need is to be born here at the moment of a parent who is also a citizen but according to many of you none are needed all you need do is be born here. Even Kim Wong only addresses the child of parents who were legal residence here not of illegal ones

There are only two kinds of US citizenship ... natural born or naturalized.. Read the statutes.. There aren't 3 kinds... and it spells out exactly who is a natural born US citizen.

Your preferred source isn't making any sense. He claims that not being allowed to vote or serve on a jury means that someone is not "subject to the jurisdiction" and therefore the birthright citizenship clause of the 14th Amendment doesn't apply to them.

Did you stop to think for a second that if what the author says is true then the 14th Amendment wouldn't have applied to freed slaves either since they couldn't vote or serve on a jury at the time. Hell, ONLY citizens are allowed to vote, so in light of that, what is the point of the citizenship clause if your article is to be considered correct?

It seems pretty clear that the author forgot what he was even talking about in his enthusiasm for his pre-conceived position.

Which is exactly what I said earlier-and actually you have most of the same rights as a citizen. Denying birth certificates is a violation of the Constitution. Stamping your feet and whining 'it's not fair' won't change a thing. In addition non-citizens have the right to file law suits in cases of discrimination. In my opinion this issue falls under that description.
