This is a good idea. Either:

He's not guilty and tells the truth and is promptly confirmed.
He's guilty and refuses to speak, and is promptly replaced as nominee by a more conservative pick, like Amy Barrett.

 

How could an investigation prove hes guilty of something 36 years ago and the accuser doesnt remember important details like where it happened or even in what year? That's the problem with accusations like this, they're impossible to prove or disprove.
