    This, of course, orients the process of law toward the past: there are certain lines that simply cannot be crossed. And, as Doerfler and Moyn point out, "constitutionalism of any sort demands extraordinary consensus for meaningful progress."

    And herein lies the problem for Doerfler and Moyn: constitutions "misdirect the present into a dispute over what people agreed on once upon a time, not on what the present and future demand for and from those who live now." The solution, they say, lies in dispensing with the Constitution entirely; the proper solution to the Constitution is in "direct arguments about what fairness or justice demands."

    After all, they admit, "It's difficult to find a constitutional basis for abortion or labor unions in a document written by largely affluent men more than two centuries ago. It would be far better if liberal legislators could simply make a case for abortion and labor rights on their own merits without having to bother with the Constitution."…

    hat is it with the bicoastal secular progressive urban elites that they want to do away with our constitution? They hate the constraints it places on their ability to exercise raw power over the rest of us. That there are some things that a bare majority can not do to the rest of us. That the urban can not inflict upon the rural their will upon a whim.

    The progressive left hates that the constitution is a bill of what they call negative rights. That instead of mandating what big government must do for us, it mandates what small government can’t and must not do to us. Progressives live to do things to us.

    The left arrogantly believes they know better than the the foundational document of our country, they pray at the alter of government prioritizing collectivism over individualism and are completely ignorant to the fact that almost every destitute third world country is that way because of government while nearly every first world country is that way in spite of government.

    Their arrogance and ignorance leads them to believe they can administer government different and desires compliance of the masses through force in order to align with their perceived utopia.

    If an idea is good, individuals will support it regardless of what government mandates.

    They can't seem to comprehend this.
