    Former President Donald Trump claims the president enjoys "absolute immunity" in civil suits related to presidential acts as he faces potential legal action for his alleged role in the Jan. 6 Capitol Riot.

    A statement Trump's attorneys presented to the court, which Fox News obtained, stated that the matter was one of separation of powers and that judicial dismantling of presidential immunity would encourage partisan harassment of elected officials through the legal system.

    learly Trump is right about this. It is a separation of powers issue. Presidents are immune from civil suits for actions they took as President. That’s the precedent.

    I have never seen an innocent person claim immunity

    Usually they just cooperate and prove themselves innocent.

    It’s insane for people to argue that this is a separation of powers issue, y’all are basically making the argument that as long as individuals are in office they can be dictators

    The executive branch can not be gang banged by its partisan opposition in the other two branches coordinating the assault

    Separation of powers means the other two branches of government are free to hold the remaining branch responsible. Why do you hate the constitution?

    Wrong. Just like members of congress have immunity for anything they say on the job on the senate or house floor.

    Clearly anyone who actually buys Trump's bullshit argument lives in complete, mouth-frothing contempt for the Constitution and for the rule of law . . . much like the man they are defending.

    Trump's actions were NOT in his official capacity. That's the difference. Congress members ONLY have this immunity when it comes to actions they took in their official capacity.

    I don’t believe that is for anything and trump wasn’t on the floor. So you are saying he could shoot someone and no charges could be brought?

    if trump had anything at all to do with organizing "alternative" electors than he is guilty of attempting to disrupt if not overthrow an election period

    The main cases here don't involve private lawyers. They have no financial incentive. If there are any slip-and-fall lawyers here, you'll find them defending Trump. The examples are already plentiful.

    I do not understand. How is this a separation of powers issue? I thought the whole point of separation of powers was so that each branch of government was free to operate independently. It was to avoid a centralization of power and provide for checks and balances. The whole point was not to have a king or ruler that could do whatever they wanted with immunity.

    While you may be correct that Presidents are immune from civil suits from official acts as president this is what is in dispute.

    People ask for immunity all the time — prosecutors often use it to “catch larger fish”.

    Except none of that money goes to said lawyers. Public lawyers don't get a cut from civil suits.
