    UPDATE

Interesting article detailing why Hopewell Circuit Judge W. Allan Sharrett order Brandon Raub released from Salem VA Medical Center. I'm not going to post the article in its entirety:

    "Activist"? Whatever...

    What a cluster.

I don't give the Raubs much of a chance with their lawsuit...

It won't be long before Americans believe their rights include abortion, food stamps, health care and sex change operations; with no concept of freedom of speech. In fact, having been brainwashed this next generation will support any "offensive" speech restrictions, especially those that penalize proselytizing by Christians.

    I'm perplexed, myself.

While I'm not privy to precisely why the Feds got involved in this case, we do have to remember that concerns were reportedly expressed by people who had read Raub's Facebook page as well as Raub's former platoon leader in the Marines. Furthermore, I think it was Raub's sharpening axes and severed heads post, which we now know are the lyrics of a Swollen Members song, are what aroused people's concerns, not his delusional 9/11 conspiracy theories.

I don't know that Chesterfield County Police are really responsible for Mr. Raub's detention. In all the years I have lived in the Richmond metro area, I have NEVER heard of anyone being detained on the grounds of complaints filed in response to Facebook posts - EVER - and we have some people in this area, most notably an anti-police anarchist group in Richmond, that have never been subjected to the treatment that Mr. Raub experienced. Maybe it's because I haven't heard about it, but given the (*)(*)(*)(*) storm surrounding Mr. Raub's arrest, one would think it would have reached the attention of the public as this case did. As I stated previously, it's not beyond the realm of possibility that the County was being pressured by Washington and perhaps Richmond to detain Mr. Raub.

To be fair, despite my questions concerning the grounds and legality of Mr. Raub's detenetion/involuntary committal, I'm not prepared to say Mr. Raub was detained with malicious intent by the authorities. I'm more inclined to think that this is a troubling example of the unintended consequences of laws such as Virginia's involuntary committal statute. As has been said, the road to Hell is paved with good questions. Regardless, I am deeply concerned with the astonishing lack of due diligence that was exercised on the part of everyone from the people who complained about Mr. Raub's posts to the judge that signed off on his detention. Fortunately, a circuit judge reviewed what happened under appeal and rectified the situation.

I won't dispute our government is completely out of control - the passage of ObamaCare and the manner it was passed in is probably the most high profile example of how all three branches of government, which were established to check and limit the power of government, have become a mutually-reinforcing vehicle that destroys the constitutional restraints placed on government and the investiture of sovereign power in the Individual OVER the government.

I absolutely agree that we need to reign in our government and return it to the constitutional box that our wise and prescient Forefathers confined it in for the sake of the freedom and prosperity of the American people.

    We're already there, YouLie.

But you make an excellent point, it's Americans who believe that nonsense and vote accordingly. The upcoming elections are really going to be an illuminating barometer of who and what we are as a people. The prospects of that outcome are even scarier than the prospect of four more years of the Obama Administration and its destructive New Left agendas...

I haven't lost all hope. Besides, we still vote with our pocketbooks. I don't think he stands a chance for re-election and this new study from the University of Colorado shows what I've been saying to my Obama-supporting friends for months. I'm sure someone will have a link up shortly.

I'm only surprised that Americans are surprised.

    Expect more of it.

You are under the control of some seriously dangerous people, imo.

    The Center for Public Integrity

The Department of Homeland Security is the first line of defense against threats to Americans, entrusted with guarding the borders, protecting the skies and cracking down on potential terrorist attacks.

But instead of protecting America's citizens, hundreds of DHS agents have been busy smuggling drugs, guns and illegal immigrants, obtaining child porn, and raking in thousands in bribes and theft.

Those are just a sampling of the crimes DHS agents committed, according to the "Summary of Significant Investigations" released by Homeland Security's Inspector General this month.

It was a busy 2011 for the IG's office, which investigated 1,389 allegations that resulted in 318 arrests and 260 convictions. Fines and recovered funds saved more than $45 million in taxpayer funds, according to agency estimates.

DHS is a massive government agency, with "over 225,000" employees, so it may not be surprising that there would be some individuals breaking the rules. But the seriousness of the crimes — including cases where American security was directly compromised by the very agents who are supposed to secure the borders and airports — is eye opening.

"A corrupt DHS employee may accept a bribe for allowing what appear to be simply undocumented aliens into the U.S. while unwittingly helping terrorists enter the country," warned Charles Edwards, the acting inspector general (IG) at DHS, in Congressional testimony August 1. "Likewise, what seems to be drug contraband could be weapons of mass destruction, such as chemical or biological weapons or bomb-making materials."

Among the more incendiary crimes profiled in the report:
•Two TSA agents plead guilty in unrelated cases of having child pornography in their possession. One was sentenced to 20 months in prison; the other received 132 months in jail.

•One border agent in Arizona physically assaulted another agent before he "pulled his service weapon and pointed it at the victim's head." The agent served an unspecified amount of time in jail.

•While on duty and driving his government issued vehicle, a uniformed Immigration Enforcement officer was viewed buying crack cocaine in Arkansas. The agent received 60 days in prison and 60 months of probation

•A detention officer at an immigration holding facility was sentenced to 10 months in prison after forcing "nonconsensual sexual contact" on an adult being detained at his facility.

•One TSA agent was arrested after he "he was observed chasing and threatening to kill a young Somali male." At the time, the agent was carrying a pair of handguns.

The agent, who had also assaulted an 82 year old Somali in 2010, became the second-ever conviction under the 2009 Matthew Shepard hate crimes act.

In all the above cases, the agents were relieved of duty.

While the largest percentage of cases came from FEMA agents — including a consultant who had to pay a nearly $3 million fine for settle a false claims suit and a contractor that billed the government almost $40,000 for a fake employee — many of the most dangerous cases involved agents from Customs and Border Protection

Also, I don't specifically know every nuance of the DOHS, as I am not American, but I have read this on more than one site, and okay, I guess you can dismiss it if you want, but it is not looking good, from where I see it..

DHS won't explain its order of 450 million hollow point bullets

After 9/11, the United States government created the Department of Homeland Security to prevent future acts of terrorism and deal with other domestic issues. Now in order to keep doing such, the agency is asking for 450 million hollow point bullets.

The DHS has signed off on an “indefinite delivery” from defense contractors ATK that will include, for some reason, nearly 500 million high-power ammunition for .40 caliber firearms. The department has yet to discuss why they are ordering such a massive bevy of bullets for an agency that has limited need domestically for doing harm, but they say they expect to continue receiving shipments from the manufacturer for the next five years, during which they plan to blow through enough ammunition to execute more people than there are in the entire United States.

“We are proud to extend our track record as the prime supplier of .40 caliber duty ammunition for DHS,” reads an official statement from Ron Johnson, ATK’s president of Security and Sporting, who adds that his group will also be giving up weaponry to the DHS subdivision of ICE, or Immigrations and Custom Enforcement.

While ammunition itself seems not too unreasonable of a request by a major federal entity that emphasizes domestic durability and safeguarding the country from coast to coast, the choice — and quantity — of its hollow point order raises a lot of questions about future plans for the DHS. ATK says they won their contract with the US government by being able to provide them with 450 million HST bullets, which it describes as “the next generation in high performance duty ammunition.”

What does that mean, exactly? On their website, the contractor claims that the ammunition is specifically designed so that it can pass through a variety of obstructions and offers “optimum penetration for terminal performance.” Or, in other words, this is the kind of bullet designed to stop any object dead in its tracks and, if emptied into the hands of the DHS a few hundred million times, just might do as much.

Since its inception, the Department of Homeland Security has not only absorbed ICE and other government entities, but has arguably extended its powers much more broadly than many had imagined. Under the recently authorized Trespass Bill, H.R. 347, protesters that allegedly disrupt occurrences acknowledged by the DHS of being a National Special Security Event will be charged with a federal crime. As the DHS gains more and more ground in fighting terrorism domestically, the US at the same time has turned the tables to make its definition of terrorist way less narrow. With any American blogger or free thinking on the fringe of what the government can go after under H.R. 347, or the National Defense Authorization Act that allows for the indefinite detention of US citizens without charge, the DHS could just be blasting through what’s left of its budget to make sure that its roster of agents across the country can get in their target practice over the next few years.

Of course, the government might just want to ensure that each one of those agents is more than able to assassinate Americans not just around the globe, but on their own soil. After all, for all of those angsty alleged Americans engaged in terrorism abroad, the US has the largest military in the history of the world to deal with them. In that case, they could argue that it only makes sense to equip their armed forces at home as well.

Neo Cons would bleat that, but Neo Cons gave you massive and large Gov.

    And made it less accountable.

And too many Americans cheered it on.

Your last President shamefully spoke of the use of the failed and immoral use of torture as policy.

And Americans shrugged. Not them being tortured, just DEM TERRORISTS.

The state began to intern people, take away their legal rights, and god knows what else, often using shady private security companies.

I do not recall too many compaining, again, most did not seem to care, in their eyes, these people were no longer humans.

Your state began to invent reasons to murder up to one million people in Iraq.

And not only were too many Americans silent, they cheered, even now they defend it, they have no shame, no humility, nothing.

None of those things mattered, no one demanded it stop.

You have literally allowed and created a total monster, an utter nighmare, a hell.

It has been hell for all those that have been on the other end of the criminals that have done this.

Did you truly and honestly believe, for one second, did those Americans that roared it on, did they really think....that these same evil minds would not want total dominion over them, as well?

Of course they did and do.

Listen, your state is so poweful now, that they do not even need to have a vote.

They could just announce that they are not having one, and that's that.

    Game over.

    What could you do?

Yeah, you have some guns, I dare some would take the gamble of fighting back, but you woud be mashed, because you all thought it was great to give the state not only rampant control, but the very cutting edge hardware.

A lot of people would be too scared, and just hope that they could keep their head down.

I see NOTHING to stop that, vote or not.

They already have all the media, they have you by the nuts, with their financial shillery, they could do what they want.

They could give you one month to cede all arms, or you would be delcared a domestic threat.

If you were found with them, after the fact, you could spend time in one of those jails that you saw privatised, and no one though about the implications of that, did they..?

Or they could intern you, and then maybe you would see that it's not so funny, when might is right is put into practice, against YOU , would you?

They have given you a whole generation of distractions, and even got you to hate on each other.

You were a very very easy target, because you believe so dearly in their authority.

    Imo.

    :)

We live in an age, when evil men have inverted all things, imo.

That is why you see awards that once had true honour attached, now given to crooks or bad men.

    Nobel 'Peace' Prize, anyone....

As Judge W. Allan Sharrett's ruling reminds us and our government, the American people are NOT under the control of the DHS, Jack. Now, you've been reminded.

However, I do fault Janet Napolitano & Co. for issuing reports declaring that returning veterans and people who have a typically-American distrust of government and high regard for individual freedom are potential terrorists. That idiocy only serves to throw more fuel on the fire of the hysteria following the recent shootings in Aurora and Milwaukee.

Unfortunately for you, Jack, history and the facts indicate otherwise. The age of big government in the United States began in the 1930s and we have the Left to thank for it.

Actually, you should find that chilling.

You start asking, okay, am I waiting for someone else to address this, am I doing anything, then you reason that it will probably be okay, then something else happens, and at what point precisely do you say 'Maybe now I should do something', and what would you do?

Sure...in this one case, a judge may have remained true to US legal values, but there are those who have eroded them, and want to do so more.

And they can, because they are a consumptive machine.

If they fail to force something through the first time, then, sooner or later, they find it tiresome, and simply alter the legislative.

Some sort of enabling act that would essentially give them 'emergency conditions', to Gov, due to 'national security'.

If they were to play that card, their powers would be far and wide, and know what, it would not take a lot to get to that, imo.

Of course, I find that troubling, which is why I pointed it out to you.

We have numerous recourses, Jack. One of them is coming November 6th.

The judge remained true to our Constitution, not our values, and the precedent set by Judge Sharrett's ruling sent a clear message to the authorities.

You're not telling Americans anything we don't already know. We've been confronting and countering that (*)(*)(*)(*) since we took up arms against your country in 1775. ;)

Tangentially, I was wondering how you all would respond to a similar situation in the UK, being as you don't have a constitution like we do here in the US.

Nonsense, Jack. If my house were on fire I would put the fire out.

The fact is, your claim that Neo-Cons gave us Big Government belies an ignorance of American history and politics, which is understandable coming from a European. Furthermore, it does no good to deny the nature of our political parties and movements and ignore their agendas. What makes people putty in the government's hands is to subscribe to your dismissiveness (motivated by your own ideological partisanship, perhaps?) and remain ignorant of these things instead of studying their long march through history and where and what they are today.

Incidentally, there are a lot of fascinating books on the history of America's political parties and movements. Judging from your silly ahistorical claim, I suggest that you consider reading them. Some of the best histories are written by the very Neo-Cons that you claim gave us Big Government - after all, many of them were prominent Leftists at one time and are quite familiar with the history of the American Left, which in some circles includes the history of the European Left going all the way back to the French Revolution.

It pays to study History, Jack. Don't kid yourself thinking it doesn't...

You presume every single soldier, sailor, marine, air force member, coast guardsman, natl guardsman will automatically fall in line.
The military would split..loyalists and patriots...it wouldn't be fun but there would be some drastic changes in how things are done...
americans have already defied the govt once during the War of Northern Aggression. White people angered are a fearsome thing. Not to be toyed with.
We weren't too scared to run the british off when they got too cocky, either.

Constitution means not a thing, that's the point.

Your state do things all of the time that are a clear and gross disregard, they have and are reducing it to but a memory.

If by Nov 6th, you mean the election, then I don't know how to put this, but it makes no odds.

Both sides are owned and on the same side, and I have genuine fears for Americans, in the next few years.

Basically, I think you are coming under the grip now something that is not even going to pretend to you anymore.

I really really wish you could vote this away somehow, I truly do.

And I admire you steadfast refusal to believe that you can.

I don't agree with it, I think you are dead wrong, but I am not really here to persuade anyone, I put info out there, I cite people that are better placed than any of us saying what I am saying now, men like Alan Sabrosky, he is a man with undoubted credentials, the survivors of the Liberty, people needed to listen to that, and join the dots fast.

You didn't. Not enough of you, and not fast enough.

Not that we are immune to the same, but for one thing, and I am no Monarch, but it is a fact that the presence of a powerful monarchy makes it v much more difficult for a totalitarian style of Governance.

    Not impossible, just much harder.

The easiest of all to subvert, politically, is a democratic republic.

The hardest to subvert would be a dictatorship, it could be a benign dictator, but that is also harder to subvert.

Your system was based on good principles, but it did not probably legislate for the country as it is today, nor the present climate.

And sadly, like I said, the easiest of all to subvert is the Democratic Republic.

With a Parlimentary democracy and a Monarchy over it, it is much much harder to break that down entirely.

Part of the reason the Russian Tzars were murdered by the brutal and savage people that needed them gone.

    You saw what then followed.

I think what would be to our advantage is our more manageable size.

Your weightyness would count against you, your numbers are no special advantage.

Because we have more workable numbers, and also because there is not the same social differences between someone from the deep south in the US, and someone from New York, for example, someone from Portsmouth in the south of England, and someone from Inverness, they will have a different accent, but it would be much much easier for us to rally a collective together, from all over the country, v fast.

I think there would be less in fighting, and, dare I say, there are (sorry, even Serf admits it!), too many people in the US with a shocking education level.

You 100% would need intelligence, brawn alone is useless, albeit a senior police chief here said, about a year or so back, that yes, we have ARU's, but if the average cop were asked to carry as standard, about 75% said they would walk out, so you have that attitude among the police here.

The people don't really have a desire for arms here, not a bad thing, because having them would lead to lots and lots of people on both sides, doing stupid stuff.

I think there would be stand off.

If it got past a few confronations etc, I think to be honest, there would be a stand off, then there would probably be an eyebrow or two raised by the like of France etc, as to what was going on.

No need to be so patronising, I am well aware that many would quit the police or armed forces, and maybe even come over.

    Yes.

    And?

There is no shortage of people they could replace them with, is there?

There are plenty in America that would happy replace them.

Or they could use those 'private security companies'.

Feck, if they really wanted to, you know all those guys on the payroll, that were passed off as 'rebels' in Libya, and Syria?

You know, the friends of your state.

Cheap labour, from a pack of absolute disgraceful killers.

I would not put it past them to hand them uniforms if they really wanted and needed to.

Your state has never been so large as it is today.

And never has it drifted so far from the people, and so much toward corporations and israel.

    Those are facts.

You can deny them, in the end, it's no skin off my nose, but it's how it is.

It hurts because you think that your vote is stil worth something.

    It's not.

Then we can all get a quick laugh and move on...

Our Constitution is why Brandon J. Raub is no longer being detained, Jack. My question to you is how people in YOUR country would deal with this in light of the peculiarities of your own legal system. As I recall, the presumption of innocence doesn't exist in your courts, and what would a gentleman like Mr. Raub do if there was no legal precedent to ensure his release?

You've got more than enough to worry about on your side of The Pond, Jack. Don't worry about us.
