Imminent domain is an occassionally necessary function of govt. However it should be a very expensive and laborious process. The current 'fair market value' stipulations arent anough. Too often the govt takes more than it needs for the project, and cronies end up buying it back for pennies on the dollar and selling for vast profits.

Anyone forced to sell their land to the govt should be paid whatever the land is worth plus any economic loss (increase in value) of the land for a time into the future (say, 10 years), plus all costs of relocating. Basically, the govt should get screwed in the deal by design, to prevent it from being practiced except when absolutely necessary.

As far as the wall is concerned, I can't see the aquisition of a strip of land wide enough for a wall and a strip of pavement to really be a cause for alarm. In most cases the property owner would be happy to settle with an easement in exchange for the heightened security, and in the rare cases they would refuse, buying them land of greater value somewhere else in a deal they would accept voluntarily will be worth the cost.

Trump is currently petitioning to take the land FIRST...and negotiate later. Of course the landowner has given up (or more accurately been forced to give up) any leverage he had at that point
