Will the Supreme Court determine Kamela Harris' eligibility for becoming President ?

    Back in 1788, the term "Natural Born" was about the physical act of giving birth to a child.

    A "natural born citizen" would be a fitting term if one of the parents was a US citizen at the time of birth.

    Kamala Harris was not a natural born citizen because neither of her parents was a citizen when she was born.

    She doesn't meet the standard set forth in the Constitution and because of this issue, should the Supreme Court be called upon to determine her eligibility?

    I would hate the idea of Pelosi becoming president but it would at least be Constitutional.

    This part of the Constitution was never amended so it is as valid today as it was at the very moment that it was ratified.

    The US constitution uses, but does not define the term "natural born citizen"

    The closest thing we have to a definition of what is a "natural born citizen" under federal law was the naturalization act of 1790 which stated "the children of citizens of the United States, that may be born beyond sea, or out of the limits of the United States, shall be considered as natural born citizens..."

    The 14th amendment also determines that someone born in the US is a US citizen, regardless of whether or not their parents are citizens

    the 14th amendment was ratified in 1866 and means exacyly what it says. "any person born" and not a word about anyone's parents. if that is not what it means then my parents were not citizens and neither am i and over 260 million more good americans. .

    more than 80 million people have voted on ms harris' eligibility.

    The Constitution reads, "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President." This is fuzzy

    It's also worth noting that the legal requirements for running for president and running for vice president are exactly the same. If one is legally eligible to run for vice president, they are also legally eligible to run for president

    The 14th Amendment to the Constitution clarifies citizenship quite clearly: "All persons born or naturalized in the United States and subject to the Jurisdiction thereof are citizens of the United States...

    it does make exception for the children of ambassadors and such who are covered by diplomatic immunity,

    So you're saying that the framers were racists. And that so is this extremist Supreme Court so they would take such claim seriously.

    I am not too sure that the second part would not be true, given that this Supreme Court has already shown their misogyny , so a display of racism would not be too huge a step for them. But the former would require them to believe that the framers didn't just require Presidential candidates to be born in the U.S., but that they were racists who believed that a candidate should demonstrate some sort of "race purity" among their ancestors. I doubt even THIS Supreme Court would go that far but... you never know.

    There is another view expressed in Law of Nations Chapter XIX by Vattel

    The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent.

    By this definition, Obama should not have been qualified as his father was never a citizen.

    Interesting, some people quote the Constitution and you rebut the Constitution with Law of Nations Chapter XIX written by a French author who wrote it in 1760. 16 years before the American Revolution.

    To be accurate, the writers of the 14th amendment did not grant citizenship to anyone born on our soil unless they were under our "jurisdiction" meaning had allegiance to the country. They talked about children of diplomats only as an example.

    Before Obama, I believe Chester A. Arthur was the only President who snuck into the Presidency despite his father not being a citizen when he was born. Lefties tried to claim that Spiro Agnew was not qualified because in their haste to disqualify Spiro, they failed to consider that his greek immigrant father may have used the greek spelling (Anagnost?) of his name in naturalization paperwork.

    Sorry, but you're 'beating a dead horse'. In 2008, American voters made it crystal-clear that they don't give a damn at all about the Constitutional requirement entailing what a "natural born" citizen is. There is now a commanding majority of voters in this country who would cheerfully 'look the other way' and elect a non-descript con-artist from Kazakhstan if it meant that his election would give them more welfare programs, write-offs, and 'subsidies'....

    I don't think so. She was born in the U.S. That makes her a natural born citizen. There is some issue regarding offspring of illegal aliens but I don't think her parents were here illegally.

    I'm not saying that Harris is not a citizen. I am saying that Harris is not a natural born citizen.

    The requirement of having to be a natural born citizen to become president was never changed.

    Nope. Her parents were not citizens when she was born. Location is totally irrelevant.

    John McCain was born in the Canal Zone and Ted Cruz was born in Canada. But their natural births involved parents who were citizens at the time of birth. .

    While her parents may have been legal immigrants, they were not yet citizens.

    For Kamala Harris? Biden picked the most unlikable candidate so that he didn't get removed from office. I don't think she has a snowball's chance in hell if winning the election. Maybe if Trump serves another term and that's how Biden got his presidency.
